5 things to check before signing any real estate contract in the Philippines
Before you sign anything, read this. These 5 checks could save you from a very costly mistake.
Real estate is one of the largest financial commitments you'll ever make. A legitimate developer and a licensed broker will always welcome scrutiny — so here's what to verify before you put pen to paper.
1. HLURB/DHSUD License to Sell
Every developer must have a License to Sell issued by DHSUD (formerly HLURB) before accepting payments. Ask for it. Verify it online at the DHSUD website.
2. Clean title or subdivision plan
Verify that the developer holds a clean title with no liens, encumbrances, or legal disputes on the land. Your broker or a lawyer can assist with title verification at the Registry of Deeds.
3. Developer's track record
How many projects have they completed? Have previous buyers received their titles? Search for reviews, visit completed projects, and speak to actual owners.
4. Payment terms and penalty clauses
Read the contract carefully — understand the monthly amortization, reservation fee, what happens if you miss a payment, and what your cancellation rights are.
5. Turnover date and penalties for delay
The contract should specify the estimated turnover date and the developer's liability if they miss it. This protects your investment and your timeline.
