Updates for First Home Buyers & Investors (WA) for FHOG/Transfer duty exemption and negative gearing updates

Transfer Duty (Stamp Duty) Updates:

(For contracts signed on or after 7 May 2026 – expected implementation around 28 July 2026)

No transfer duty on established homes up to $600,000
Reduced transfer duty for homes up to $800,000
No transfer duty on land up to $450,000
Reduced transfer duty for land up to $550,000

First Home Owner Grant (FHOG) Changes:

Increased caps:

Up to $800,000 (previously $750,000) for homes south of the 26th parallel
Up to $1,000,000 for homes north of the 26th parallel

FHOG caps are now separate from duty concessions, meaning eligible first home buyers can still access stamp duty relief even if the purchase price exceeds the FHOG cap.

Negative Gearing Update:

Properties owned before 7:30pm AEST, 12 May 2026 are fully exempt
Properties already under contract (even if not settled) will retain negative gearing benefits into the future
This ensures investors who have already made decisions under the previous rules will not be impacted.

🏡 2026–27 WA Housing Taxation Package Announced

The WA State Government has announced major housing tax reforms designed to support first home buyers, increase housing supply, and improve affordability across Western Australia.

📅 Key changes apply to transactions entered into on or after 7 May 2026 (subject to legislation passing Parliament).

What’s Changing?

Higher Stamp Duty Exemptions for First Home Buyers

The First Home Owner Rate of Duty (FHOR) thresholds will increase:

Established & Newly Built Homes:

No stamp duty on homes valued up to $600,000 (previously $500,000)
Reduced duty available for homes valued up to $800,000 (previously $700,000)

Vacant Land

No stamp duty on land valued up to $450,000 (previously $350,000)
Reduced duty available for land valued up to $550,000 (previously $450,000)

First Home Owner Grant (FHOG) Cap Increased

FHOG cap for homes south of the 26th parallel increased to $800,000 to reflect rising construction costs.

More Flexibility for First Home Buyers

Buyers may still qualify for stamp duty concessions even if the property value exceeds the FHOG cap.

New Foreign Buyer Duty Exemption

New exemption for eligible “build-to-sell” developments that increase housing supply.

Off-the-Plan Duty Concession Extended

Announced on 12 March 2026:
Extended until 30 June 2028
Increased value thresholds
Expanded eligibility to include survey-strata and community title developments

Expected commencement date: 28 July 2026

Eligible transactions entered into between the announcement date and commencement date may initially be assessed under current rules, with reassessments and refunds issued after implementation.

🌟 Good News for WA Home Buyers! 🌟

The WA Government has announced expanded stamp duty concessions for off‑the‑plan and under‑construction properties, and the changes are effective immediately. This significant stamp duty reforms as part of its $70.6 million investment in the 2026–2027 State Budget, aimed at improving housing affordability and boosting supply across Western Australia.

What’s Changed?

🏡 More homes now qualify
Duplexes, triplexes, villas, townhouses, apartments, and other survey‑strata homes are now included. This means buyers aren’t limited to large apartment complexes.

💰 Higher price limits

Full concession (no stamp duty) now applies up to $800,000 for off‑the‑plan purchases.
Partial concession tapers up to $900,000.

🔨 Under‑construction savings

75% concession up to $800,000
Tapers to 37.5% at $900,000

💸 Example savings
On an $800,000 property, buyers can save:

Over $32,300 when purchasing off‑the‑plan
Over $24,200 during construction

The concession, which was due to end on 30 June 2026, will also be extended until 30 June 2028, continuing the assistance available to buyers, providing more certainty to the multi-residential housing market

If you're looking to buy property in WA whether it’s a home or vacant land make sure you're across the new Dutiable Value Thresholds that came into effect from 21 March 2025 for the first home buyers.

These changes affect how much transfer duty (stamp duty) you'll need to pay, based on your contract date and date and property value.
Here’s a quick breakdown:

Home & Land Transfers:

Metropolitan & Peel Regions
No duty up to $500,000
$13.63 per $100 for $500,001–$700,000
Max value eligible: $700,000

Outside Metro/Peel Regions
No duty up to $500,000
$11.90 per $100 for $500,001–$750,000
Max value eligible: $750,000

Vacant Land Transfers (All WA)
No duty up to $350,000
$15.39 per $100 for $350,001–$450,000
Max value eligible: $450,000

Key Points to Remember:

These thresholds apply to contracts signed on or after 21 March 2025

Transfer duty is based on the full property value, not your share

Earlier thresholds still apply for contracts signed before this date

UPDATE FROM REVENUE WA

First home owner rate of duty and off-the-plan duty concession

The State Government has announced changes to:

• increase the value of vacant land and homes eligible for the first home owner concessional rate of duty and

• extend the eligible contract dates, increase the value thresholds for pre-construction and under construction contracts, and expand the concession to off-the-plan purchases of single-tiered strata or community title (building) scheme dwellings (but not a survey-strata scheme).

The changes will apply to transactions entered into from 21 March 2025.

The changes cannot be applied until legislation is introduced into Parliament and updates to RevenueWA’s systems have been made.

• Transactions entered into on or after 21 March 2025 that are eligible for a reduced amount of duty but settle before the changes can be applied may be reassessed for a refund of duty after settlement.

• We will provide updates on our website about when these changes will be applied.

Changes have been announced to the first home owner rate of duty thresholds and the off-the-plan duty concession.
