This is new legislation starting Saturday 1st October 2022.

The Real Estate Institute of Queensland (REIQ) is highlighting the value of property managers as the most significant rental legislative reforms in more than a decade come into effect on 1 October.

A few months ago I commented on the plight of first home buyers trying to buy into this crazy housing market.
Today a few words about tenants trying to find somewhere to rent.
As more owners list their rental properties for sale it means fewer houses available to rent. Owners with a couple of properties will naturally sell an investment property before their own homes. With so many first home buyers in the market desperate to buy, it means they will be the majority of potential buyers. Investors are in the minority so we see fewer properties to rent.

We are seeing record numbers of people moving to Queensland which already has a housing shortage. Many of these new arrivals are wanting to rent so more pressure builds on our strained housing situation.
I have spoken to many renters lately and my heart goes out to them in their situation. They are desperate to find somewhere. It is not easy for them.

Can I remind everyone that tenants are protected by their leases? A number of owners seem to think they can get just give their tenants
a few weeks notice when they want to sell and the tenants will have to move. Not so. Tenants have every right to remain in their rented property and not vacate until their lease expires.
Sadly I have heard of some agents promising potential buyers not to worry about buying a rented property because they, the agents will arrange to get them out. A lease is a legal contract between the parties and agents can not get people out of a lease unless the tenants choose to vacate.

Spare a thought for the first home buyers struggling to get into the market.
There are those whose earnings and savings are not enough to get a loan.
Then there are those who have secured a loan and are frantically searching every day for a property. Sadly, everything seems to be sold by the time they find a place of interest.
It's cruel.
The housing market is a sellers market now but the cycle of the housing market is such that it keeps turning and when this current boom ends...and all booms end...it will be a buyers market again.
Right now, buying a property is like buying shares at the top of the market. We are told to only buy when share prices go down but we dont do that with property?
If the struggle is getting to you, take a break and stop house hunting for a while. Prices may not fall but they will stabilise. Concentrate on saving as much as you can in the meantime. It isnt easy but be patient. Your time will come.

It’s easy to forget in this crazy real estate world that property transactions are not just about buyers and sellers but in some cases tenants as well.
Many owners are naturally trying to cash in on the sellers’ market we have but if they own investment properties it’s the tenants whose interests are often overlooked.
Tenants should be protected by their leases but in some cases are being railroaded to vacate by being offered financial compensation by the owners.
Fair enough if they are happy to vacate with this incentive but many are not as it is so difficult to find another rental.
As always it is about compromise.
Our policy when an owner wants to list his investment property for sale is to sit down with the tenants and explain the process assuring them they are protected by their lease. We arrange suitable times for inspections and open houses to fit their schedules.
Importantly, while our property managers know the tenants, we sales people may not. By building trust with the tenants from the start and their knowing we will look out for their interests ensures the sale will go smoothly.
Please, if you own investment properties, look after your tenants. It will pay dividends and it’s just the right thing to do.

You are probably aware we are in the middle of a housing boom.

Because of the uncertainty about prices more and more houses are being advertised without a price. Buyers are hard pressed to find a house with an asking price or price guide as they scroll through Realestate.com and Domain.

In Queensland, it is illegal to give buyers a price guide if the property is advertised without a price or going to Auction. We can
provide buyers with a list of comparitive sales in the area but nothing more.

Both Realestate.com and Domain have been telling agents for years that many buyers do not bother to engage with a property advertised without a price. Auctions are an exception as most people are aware of how they work. When many buyers see "For
Sale Now", "By Negotiation","Make an Offer", etc they simply tune out.

Why advertise without a price? Agents say in a rising uncertain market they are doing owners a disservice by putting a price on a property as they may undersell it. If a lot of buyers are not even looking at their property isn't that doing even more of a disservice?

Looking for a property is stressful at the best of times. With no price guide it makes the process even harder, especially for inexperienced first home buyers.

Our policy is to always put a price or a price guide on any advertised property unless it is going to Auction or we have been instructed by the owners otherwise.

We are confident more buyers will engage with our listings on the internet. This achieves the best results for our owners and makes the buying process easier for buyers.
