The final part of the NSW Government’s Criminal Justice Reform Package is in effect from today, 24 September 2018. The final stage of the Criminal Justice Reform brings tougher sentencing, and replaces the current good behaviour bonds, community services orders, suspended sentences and home detention sentences. Additionally, domestic violence offenders will receive a prison term or supervised community-based sentence and will no longer be allowed to live with their victim.
The Criminal Justice Reform is intended to reduce the number of re-offenders by encouraging mental health assessments, ensuring stricter supervision, and allowing better access to programs designed to help people adjust to life outside of prison.
The Court can now impose the following sentences:
1. Conditional Release Orders replace good behaviour bonds for minor offences and can be granted with or without a conviction for up to 2 years.
2. Community Corrections Orders may be imposed instead of imprisonment up to 3 years. These orders may require offenders to have a curfew, engage in community service or be under correctional supervision.
3. An Intensive Corrections Order may be imposed for offences which carry a prison sentence of up to 2 years and allows sentences to be served through home detention, admission to rehabilitation centres, or mental health facilities.
4. Suspended sentences have been abolished, however, existing suspended sentences continue to operate until they lapse or are revoked.

Changes to the Family Law Act are now being introduced to allow the Court to provide protection for victims of domestic violence. The changes are designed to prevent self-representing parties who are accused of domestic violence from being able to directly cross-examine their victims, and use the legal system to further injure their ex-partner.
This looks to be the start of many changes to the Family Law Act, and one which will hopefully provide a safer environment for victims of domestic violence.
