Ban on foreign purchases of established dwellings

The Federal Government has announced a ban on foreign investors from buying established homes for at least two years and a crack down on foreign land banking.

From 1 April 2025, foreign investors (including temporary residents and foreign owned companies) will no longer be able to purchase an established dwelling in Australia while the ban is in place unless an exception applies.

Retirement Villages Regulation
The current Retirement Villages Regulation will expire on 1 September 2025 and the NSW Government is seeking feedback on how to improve, modernise and streamline the current laws.
The proposed updates aim to improve transparency for residents and reduce unnecessary administrative work for operators. The proposed Regulation also makes other minor changes to clarify the laws and improve how they operate, for example, by ensuring key information is disclosed in a form that is easier to understand and accessible.
Submissions can be made in writing or by responding to the online survey. All information can be found here:

Fire Safety Regulation Reforms

The Building Commission NSW has issued a fact sheet setting out recent changes to fire safety regulations.

Commencing 13 February 2025, these changes will impact on how fire safety measures are certified, maintained, and implemented in buildings across the state.

In particular, building owners (except single dwellings) must maintain essential fire safety measures and routinely arrange for inspection the service of fire protection systems and equipment, and must use an accredited person(s) to certify newly installed fire safety measures before issuing a fire safety certificate and include relevant information about that accredited person in the fire safety certificate.

Please note that this may not apply to 2 lot strata plans. However to maintain safety and legal compliance, always check with the local council for specific fire safety requirements and guidelines applicable to the scheme.

Govt has announced Rent Check, developed by the NSW Rental Commissioner, providing updated, current data on rent prices for comparable properties in their suburb Unlike current commercial apps Rent Check uses the latest bond data to provide a more accurate and comprehensive breakdown of market prices. The new website will help renters compare pricing and identify excessive rent while also helping owners better understand the range of rent being charged for similar properties in an area.

Photo Card Regulation 2024

Transport for NSW (Transport) is seeking public comment on the draft Photo Card Regulation 2024 and Regulatory Impact Statement.

The Photo Card Act 2005 authorises and enables Transport to issue a Photo Card to residents over the age of 16. The Photo Card can be used as evidence of the age and identity of the person.

The Photo Card Regulation 2014 (the existing regulation) supports and contains provisions for:

* fees and exemptions
* the surrender and cancellation of photo cards
* change of particulars such as name and address
* use of digital photo cards
* release of information on the Photo Card Register
* release of photographs
* penalty notice offences.

Transport is proposing to remake the regulation subject to a number of minor amendments and is seeking public comment on the draft Photo Card Regulation 2024.

In addition, the attached Regulatory Impact Statement seeks feedback on whether additional changes are required.
