A quick AML/CTF update for all of our clients and real estate partners 👀

We're now less than a month away (😮) from some important changes to the way property transactions will be handled. In practice, this means you'll notice a few things happening much earlier in the process, including...

➡️ ID checks completed right at the beginning of your transaction
➡️ Depending on the circumstances, we may also need to ask questions around the source of your funds or wealth

Now, before anyone panics 😅, this won't be complicated for most people. It simply means gathering information earlier so we can meet our obligations and keep your transaction moving smoothly.

Behind the scenes, we've been doing a lot of work to make this as seamless and secure as possible for our clients, including training our team and putting the right systems in place.

For our real estate partners, we'd love to chat about how you're finding the lead-up to these changes. Given that AUSTRAC has not shared any information about these changes with the general public, no doubt we'll all be on the receiving end of plenty of questions from our buyers and sellers!

Tiny delays can sometimes come with surprisingly big price tags... 🫣

Settlement delays, however hard you try to avoid them, are sometimes out of your control. Things like...
📄 Mortgage documents or discharge paperwork not signed in time
📄 ID checks still outstanding
📄 Missing paperwork

And depending on the circumstances? Delays can sometimes lead to penalty interest being payable 😬

The good news is that many of the common causes can be avoided with a little preparation. Sign documents promptly, complete requests as soon as possible, and if you're heading away over public holidays or school holidays, make sure everything important is sorted first 🙌

And if things do look like they're heading into penalty interest territory, here's how that gets calculated...
➡️ [Purchase Price] less [Deposit] multiplied by 9% divided by 365 [days of the year]

For a property sold for $1,000,000, with a $20,000 deposit, you're looking at penalties of $241.64 per day, including public holidays and weekends 💸💸

First home buyers - no doubt you saw the WA State Government's announcement in last month's budget, so we wanted to dive a little deeper and explore what this means for you 🏘️

The changes aim to help more buyers get into the market, including...

🏠 Higher First Home Owner Rate (FHOR) thresholds
No duty on homes up to $600,000 (previously $500,000), with concessions extending to $800,000
No duty on vacant land up to $450,000 (previously $350,000), with concessions extending to $550,000

🏠 Removal of the link between FHOG caps and FHOR eligibility

That last one is more important than you might realise 👀

Previously, if your land + build value pushed you over the FHOG cap, you could miss out on the duty concession, too. Under these changes, buyers may still qualify for the First Home Owner Rate concession, even if the total transaction value sits above the FHOG cap.

All of these measures still need to be legislated, and RevenueWA is currently updating its systems. The expected implementation timeframe is around late July 2026.

If you qualify under the new rates before the systems are updated, you'll need to pay the higher amount at settlement initially and then apply for a refund once the changes are in place.

Have your finance pre-approval sorted and your team in place so you can act fast when the right property comes up.

🏘️ Build relationships.

Getting the keys early sounds tempting… but it’s not always as simple as it seems 👀

Taking prior possession (moving in before settlement) comes with a few important risks to consider...

⚠️ Insurance. It can be difficult (read: seemingly impossible) to get the right cover in place before you legally own the property.
⚠️ Duty implications. If you take possession before settlement, you'll be liable for stamp duty even if the deal doesn’t ultimately proceed.
⚠️ Overall risk. If something goes wrong before settlement or the property is damaged (even through acts of nature or crime), things can get complicated very quickly.

Every situation is different, but this is definitely one where you want to pause and get the right advice before saying yes.
