Question
My client is selling a unit which is part of a 3 lot subdivision. He owns all 3 but is selling one

Only two lots use the driveway but the unit he is selling does not use the driveway

Do you need insurance if you don’t use it?

Answer:
Yes. It’s part of the 3 Lots.

You cannot sell a lot affected by owners corporation without public liability insurance for common area

A contract is voidable by a purchaser right up until settlement date under Section 11 Sale Of Land Act. 🤦🏻‍♀️

Some things to consider when purchasing a property, such as an apartment, unit or townhouse, off-the-plan include:
•
How many lots will form a part of the development?
•
Will the property be subject to one or more Owners Corporation?
•
What will the initial Owners Corporation fees be?
•
Will you have a parking space and how many will you have?
•
Who will be the builder for the development?
•
Has the builder built similar developments before?
•
Are they reputable? Can you see a similar development they have built before?
 
Asking questions will help you understand the eventual product you are likely to end up with.
