Big Changes to Selling Property in Queensland

From 1 August 2025 it will be necessary for a Seller to provide to a Buyer with a Disclosure Notice that complies with the requirements of the Property Law Act 2023 prior to a contract of sale being signed.

The Disclosure Statement is an important legal document. Failure to provide a compliant Disclosure Notice will enable a Buyer to terminate the contract.

To prepare a Disclosure statement it will be necessary to undertake some searches and make some enquiries in relation to the property. The extent of these investigation can vary from property to property. This will not necessarily be an instantaneous process.

Prior to listing your property for sale we would recommend that you have your solicitor attend to preparation of the Disclosure Statement. Being proactive with the preparation of the Disclosure Statement will ensure that you can provide a compliant disclosure statement to a Buyer and be aware of any issues that may affect the listing of the property. This will assist you in having a smooth listing and sales process.
