The word “Caveat” in Latin means “let him beware”.

A caveat is a legal dealing registered on a Certificate of Title, to protect a person or entities legal interest in a property.

What does a caveat do?
Lodging a caveat means that the owner of the land cannot transfer, mortgage or otherwise deal with the land without the caveator's consent (unless the caveat is released or a Court orders otherwise).

Who can lodge a caveat?
When a purchaser signs a contract to purchase real estate, the purchaser acquires what is known as a “caveatable interest”. This means that the purchaser is entitled to register a caveat to protect that interest.

The following situations also give rise to acquire a “caveatable interest”:

• An equitable interest including an equitable lease or an equitable mortgage;
•An option to purchase the property in the future;
•An interest under a resulting trust;
•An easement or encumbrance;
•Under a ‘charging clause’ in a contract or agreement; or
•In some circumstances where you have contributed to the purchase price of a property(without being registered on title) or contributed to the improvement of the property.

It’s vitally important to understand that only a person who has a caveatable interest is entitled to lodge a caveat. Lodging a caveat without expert legal advice can be risky, as you can become liable for the land owner’s damages and other costs if you improperly lodge a caveat.

When should a caveat be lodged?
A caveat should be lodged as soon as a caveatable interest is acquired (usually as soon as the purchaser’s offer has been accepted by the vendor of the property).

If a caveat has not been lodged immediately after the purchase, it should be lodged as soon as there is a danger that another party may attempt to register an interest in a property.

Sometimes a real estate contract will prohibit the lodging of a caveat, and so legal advice should be sought before the caveat is lodged.

What does is cost?
$40-$50 for Land Titles Office registration fee and $110-$180 for a conveyancer or lawyer for providing legal advice, preparing the caveat and lodging the caveat at the Land Titles Office.
