With more houses getting ready to be listed, we are looking forward to a busy end to the 2024 year.

SOL Conveyancing has recently grown in size with 2 new members joining the team.

Anya, joined us in early July. I have previously worked with Anya and she is both experienced and knowledgeable. We are excited to have Anya as a part of the SOL team.

The second and youngest member to join the team is Tilly. Our daughter joined the world in late July and we are completely smitten with her.

Please ensure that you undertake a proper walkthrough inspection of the property prior to signing to ensure that you are satisfied.

I also suggest testing all appliances to ensure they are in working order. This may include cooktops, ovens, dishwashers, heaters, air conditioners, locks etc.

I recommend that you document the condition of the property, such as taking photo evidence on the day of signing so that you have proof of the condition should a dispute arise prior to settlement.

I recommend you arrange for a pest and building inspection prior to placing your offer. The report will identify any major or minor defects, giving you a better position to determine your highest bid. Yes, I suggest making all offers subject to finance even if you have a pre approval. This is to minimise the risk of the bank’s valuation of coming back as per the contract price, if this occurs then the purchaser is required to provide more funds. Please note that the vendor may not want the contract made subject to finance if the property is being sold by auction.

Joint proprietors hold an interest in the land jointly and if one of the owners dies, the property automatically passes to the surviving proprietor. Whereas, tenants in common can each hold equal or unequal shares, and if one of the owners dies, their share would be dealt with in accordance with the will.

The cooling off period of three clear business days applies in the table titled important notice to purchasers on the Contract of Sale page, it sets out the instances in which you may cool off, this gives you time to consider the offer. It begins from the date you sign the contract, not from the date the vendor signs it. Should you decide you no longer want to buy the property, you can cool off by giving written notice to the seller or the agent within the required timeframe. You will be entitled to a full refund of any money paid, less $100 or 0.2% of the purchaser price, whichever is greater. We still highly recommend you getting the Contract of Sale and Section 32 Statement reviewed prior to signing as this can be difficult to negotiate terms if you have already signed.

I always highly recommend having the Contract of Sale and Section 32 Statement reviewed prior to signing. This is to ensure you understand what you are purchasing and completing your due diligence prior to signing. This also gives you the chance to negotiate any terms that may need to be amended or deleted in the Contract that may not be in your best interest.
