Your family shouldn’t have to guess what you would have wanted.

Estate planning isn't only about deciding who receives your assets after you die.

It's also an opportunity to think about some important questions.

Who would you want to look after your estate?

What would you want to happen to the things you leave behind?

And who would you trust to make important decisions for you if you were unable to make them yourself?

These aren't always comfortable conversations to have.

But putting your wishes in place can provide valuable clarity for you and the people you care about.

Estate planning is about making important decisions while they're still yours to make.

If you're unsure what you should have in place, Brite Legal can help make the process feel simpler.

Been separated for a while but still haven’t sorted out your property settlement?

You may not have left it too late but there are some important time limits to be aware of.

If you were married, the usual time limit for applying to the Court for property orders is 12 months after your divorce becomes final.

If you were in a de facto relationship, the usual time limit is two years from the breakdown of the relationship.

And an important point people sometimes miss: separation and divorce aren't the same thing.

If you were married but haven't divorced, the 12-month period after divorce becoming final hasn't started simply because you've been separated for a long time.

If a time limit has already passed, that doesn't necessarily mean there is nothing you can do, but you may need the Court's permission to proceed.

So if your property settlement has been sitting on the “we’ll sort that out later” list, it may be worth finding out where you stand.

Brite Legal can help you understand the next steps for your circumstances.

Reaching an agreement with your former partner is a great step forward but it doesn’t necessarily mean your property settlement is formally finalised.

An informal agreement about who keeps what isn’t necessarily the same as having a legally binding property settlement in place.

Depending on your circumstances, there are different ways an agreement can be properly formalised.

This can be an important final step, even when you’re both on the same page.

Already reached an agreement?

Brite Legal can help you work through what may be needed to properly finalise your property settlement.
