Under NSW tenancy law, you must get your landlord's written permission before subletting any part of your property or adding a co-tenant to your lease. This applies whether you are looking to share with a friend or bring in someone new to help with the rent.

What most renters do not realise is that their landlord cannot unreasonably refuse a request to add a co-tenant or sublet part of the property. If they do refuse, they need a legitimate reason.

When it comes to costs, landlords can only charge their reasonable, actual expenses of giving consent. They cannot use this as an opportunity to charge additional fees beyond what they have genuinely incurred.

A few things to keep in mind before you proceed:

βœ… Any costs charged must be reasonable and evidenced

Under NSW law, landlords are legally responsible for ensuring smoke alarms are working at all times across every storey of a rental property. This responsibility cannot be passed to a tenant through a tenancy agreement.

If a tenant notifies you that an alarm is not working, you have 2 business days to repair or replace it. Alarms cannot be removed or disabled under any circumstances.

For properties in a strata scheme, the tenancy agreement must clearly state who is responsible for smoke alarm repair and replacement.
