Under the new AML/CTF laws, we can't proceed with a settlement until identity verification and source of funds checks are complete.

That means if documents are missing or delayed — so is your settlement.

The good news? Getting ahead of it is easy:

Why are these laws being introduced?

Australia's property market has long been identified as a risk area for money laundering and financial crime. These new laws close a significant gap. From 1 July, settlement agents must:

✅ Verify the identity of every client
✅ Understand where funds are coming from
✅ Report suspicious activity where required The goal isn't to inconvenience honest buyers and sellers — it's to protect the integrity of the property market and make it harder for criminals to use real estate to hide illegal money.

The big news: AML laws expand to property settlements on 1 July

📢 Important update for anyone buying or selling property in WA. From 1 July 2026, new Anti-Money Laundering and Counter-Terrorism Financing (AML/CTF) laws apply to settlement agents and conveyancers — including us. This means we'll be asking clients for some additional information and identity verification as part of every transaction. 📢 BUDGET 2026 | Property Tax Changes — What You Need to Know

The Federal Government has announced two significant changes to property investment rules, effective 1 July 2027. Here's a quick summary:

🏠 NEGATIVE GEARING
From 1 July 2027, negative gearing will be limited to new builds only. Losses on established homes can no longer be offset against wages.

📈 CAPITAL GAINS TAX
The current 50% CGT discount (for assets held 12+ months) will be replaced with CPI indexation plus a 30% minimum tax on real capital gains.

✅ ALREADY OWN AN INVESTMENT PROPERTY?
If you purchased before 7:30pm AEST on 12 May 2026, you're grandfathered — your existing tax benefits remain protected.

🗓️ KEY DATES TO KNOW
• 12 May 2026 — Negative gearing restricted for new purchases of established homes
• 30 June 2027 — Last day to negatively gear an established property against wages
• 1 July 2027 — Full restrictions and new CGT rules take effect
• 1 July 2028 — 30% minimum tax on discretionary trusts begins

🏗️ THINKING OF INVESTING?
New builds retain full tax concessions, making them increasingly attractive under the new rules. A transition window is still open — established properties purchased before 30 June 2027 can still be negatively geared against wages during that period.
