Thousands of students across NSW are starting the academic year at university, TAFE and other vocational education providers.
Before you sign a lease, make sure you understand your rights and responsibilities as a renter.
Moving out of home is a big step. Knowing what to look for can help you avoid problems later.
Before signing, remember:
✅ Have a written lease agreement
Your lease should clearly outline rent, payment frequency, bond requirements and responsibilities. You must receive a signed copy that includes landlord or agent contact details.
✅ Understand how rental bonds work
A bond cannot be more than four weeks’ rent and must be lodged with NSW Fair Trading. Your bond is refundable to you at the end of the tenancy if there is no unpaid rent or damage.
✅Fees and Charges
Landlords and agents can only charge certain fees at the start of a tenancy such as a bond, a holding fee and up to two weeks’ rent in advance. You cannot be charged for things like a background check or preparing a lease.
✅ Know your landlord’s responsibilities
Rental properties must be safe and liveable, and necessary repairs must be completed.
✅ Know the rules around ending a lease
Landlords and agents can only issue a termination notice for certain reasons and must follow the correct legal process. Heavy penalties apply to landlords or agents who give a termination notice with a ground that is not genuine.
✅Know the new rules about rent
Recent rental reforms mean rent can only increase once per year, renters must be offered rent payment by bank transfer or Centrepay, and agents cannot solicit higher rental offers.
