🏢 Strata Law Reforms (NSW) – Effective 1 April 2026
Are you ready for the changes coming into effect 1st April 2026?!
Key Changes
1. New Information Certificates (Section 184 / 174)
Information certificates must now include additional disclosures such as:
• Utilities via embedded networks
(E.g. electricity, gas or water supplied through exclusive supply arrangements)
• Meeting history and schedule
(Meetings held in the past 12 months & upcoming meetings)
2. Initial Maintenance Schedule (IMS) – Developer Obligations
Developers (original owners) must now use new standard IMS forms before the first AGM. The IMS gives owners corporations of new strata schemes clear information about the obligations and costs involved in maintaining the common property. This change is designed to improve the accountability at the stage of development and provide greater confidence in budgeting.
3. 10-Year Capital Works Fund Plans
The new requirement, is that all owners corporations must use a standardised form provided by NSW Fair Trading when they:
• Create a new plan
• Replace an expired plan
• Update an existing plan

Are you ready for the changes coming into effect 27th October 2025?!
🔑Key Changes

Financial Hardship Support

* Every strata levy notice must include a mandatory Financial Hardship Information Statement.

* Translations of the Financial Hardship Statements available in 10 languages and NSW Fair Trading website.

* Fairer Debt & Payment Plans

* Owners can request payment plans using a standard form.

* Strata committees must consider such requests and reply within 28 days.

* No fees can be charged for these requests.

* Debt recovery cannot proceed while a valid payment plan is in place and being followed.

* Payments must be applied in order: oldest levy → interest → recovery costs.

Building Manager Duties

* Must act in the best interest of the owners corporation.

* Must report repair/safety issues and disclose any financial interests.


Common Property Maintenance
* Owners corporations must meet repair obligations, especially where health or safety is at risk.

Levy notices must now contain the payment plan form and fair trading advice.

The legislative requirement falls under section 85 of the SSMA 2015.

We understand there are times when owners fall into hardship and owners corporations now have a compulsory duty to allow payment plans to take place at schemes, but also have a duty to consider whether the payment plan is reasonable as part of their duties.

There is presently frameworked consideration into strata committee training to better educate these voluntary members of the Owners Corporation to ensure decision-making is performed taking compliance and fairness into account.
