FAQ: VARIATION'S IN BUILD CONTRACTS

Variations document what has changed from your original, signed build contract. They document the supply cost of the changed item, along with any additional costs that relate to labour, materials and administration fees to implement the change. Variations should be formally documented and agreed upon by all parties before the new (i.e. variation) work can commence.

Variations arise for two main reasons:

1. Client-requested change: This is the most common form of variation. It’s when a client changes their mind on something after they have signed their build contract or after the previously agreed scoped work has been completed. For example, the client decides to add a new window to a room, add additional power point outlets, or change the paint colour on a wall after it has been painted.

2. The result of unforeseen work: This form of variation is common for major renovations and extensions because there are unknowns which cannot be known about until demolition reveals the “truth behind the walls”. If there is no way of knowing about a certain issue at the time of quoting your project (e.g. the discovery post-demolition of asbestos hidden inside your walls), it’s considered an unforeseen variation which needs to be addressed first, before the builder can complete the originally-scoped work.

Each time a variation is raised it typically comes with an Extension Of Time (EOT) attached to it.
