Brisbane landlords: QLD rental rules have changed — and that changes how you should think about strategy. 🚨

If you’re deciding between long-term rental (LTR) and short-term rental (STR), here are 3 shifts worth paying attention to:

1️⃣ Rent timing is tighter

In Queensland, rent increases are generally limited to once every 12 months per property — not every new lease. That means a change of tenant does not automatically reset your pricing flexibility.

2️⃣ Regaining possession is more procedural

Periodic tenancies can no longer be ended “without grounds”. Fixed-term agreements can still end lawfully, but owners need to follow the correct legal pathway and notice process.

3️⃣ Compliance is now more operational

Minimum housing standards now apply across QLD rentals. If a property does not meet the required standard, that can create issues at move-in and may trigger the emergency repairs process during a tenancy.

What this means commercially:

LTR is still a valid model — but it now rewards owners who prioritise stability, process, and compliance.

If your priority is flexibility, faster market response, or active yield management, it may be worth comparing that against an STR approach before you commit.

NSW Landlords: the “hidden trap” of long-term leases 🧾⚠️

Since 19 May 2025, “no grounds” evictions are unlawful in NSW.

That means you can’t end a tenancy just because you want to:

you must have a valid legal reason + evidence + correct notice period.

Key reality checks 👇

A termination notice ≠ the tenancy ends. The tenancy ends only when the tenant moves out and returns the keys.

If the tenant doesn’t leave, the landlord typically must go through NCAT for a termination order, then (if needed) a warrant, and only a Sheriff can physically remove the tenant. ⏳⚖️

This applies to fixed-term + periodic (ongoing) agreements.

So when you choose long-term rental, treat it like:✅ stable income 📈❌ low flexibility + higher exit friction 🧱

NSW State Govt vs. City of Sydney: “Levy” or “Cap”? 🏛️💸

City of Sydney is investigating a tighter day cap for un-hosted short-term rentals.At the same time, the NSW Government has been reviewing the STRA framework and has floated options like a booking tax/levy on platform revenue.

Here’s the Red Team view:

📉 The Cap (hard constraint): once you hit the annual limit, your STR channel revenue goes to $0 for the rest of the period. Flexibility dies; vacancy/strategy pivots get forced.

💸 The Levy (variable cost): it compresses margin per booking, but you can still operate year-round if caps don’t tighten further.

Insight: a tax/levy is a variable cost problem. A tighter cap is a capacity ceiling problem.

💡 The Strategy: yield management (dynamic pricing + minimum stays + channel mix) can sometimes offset a levy during peak demand, but only if your pricing system is built to adapt.

Evidence from the Byron Bay 60-day cap says NO. 🚫

Independent analysis by Frontier Economics found that strict caps failed to deliver on the promise of affordable housing.

Instead, after the caps were introduced:

1️⃣ Long-term supply stayed flat.

2️⃣ Rents actually increased (~7%).

3️⃣ More homes were left empty ("Lock-up & Leave").

The Reality: Cutting rental days doesn't guarantee more housing; it often just kills flexibility.
