Here are some of the most important things I encourage every buyer to consider before making an offer.

𝐙𝐨𝐧𝐢𝐧𝐠 𝐂𝐨𝐦𝐞𝐬 𝐅𝐢𝐫𝐬𝐭

The first question should not be "Can I build a barn?" It should be "What does the zoning allow?" If you plan to keep horses, chickens, goats, or other livestock, confirm exactly what the municipal zoning permits, as this varies significantly from property to property. If future buildings are part of your plans, also check for Conservation Authority regulations. Organizations such as the Niagara Escarpment Commission, Credit Valley Conservation, or Grand River Conservation Authority may limit where and how you can build, regardless of zoning.

Gross Lease vs. Net Lease: Understanding the Difference

When evaluating a commercial property in Ontario, it is important to understand the type of lease being offered. Commercial leases here are governed by the Commercial Tenancies Act, which gives tenants far less built-in protection than residential tenants receive. This makes the lease terms themselves the deciding factor.

Under a gross lease, the tenant pays one fixed rent amount, and the landlord covers property taxes, insurance, and maintenance.

Under a net lease, the tenant pays base rent plus a share of property taxes, insurance, and maintenance costs, often referred to as additional rent or TMI (taxes, maintenance, and insurance). Triple net (NNN) leases, where the tenant is responsible for all three costs, are common across many types of commercial properties in Ontario, including retail, industrial, and office buildings. Base rent is often lower, but additional costs may vary from year to year.

Neither option is better across the board. The right fit depends on a tenant's budget and risk tolerance, and a landlord's investment goals.
