An important change for Ontario rent arrears hearings:

If the landlord filed the rent arrears application on or after September 21, 2026, a tenant who wants to raise other issues at that hearing—such as maintenance or tenant-rights concerns—must pay the landlord half of the arrears claimed at least 7 days before the hearing.

The existing requirement to give the landlord and the LTB a description of those issues at least 7 days before the hearing still applies. Tenants should keep proof of any payment.

What counts as persistent late payment of rent in Ontario?

As of September 21, 2026, the Residential Tenancies Act specifies that rent received more than 7 days after its due date, at least 3 times within 6 months, is persistent late payment.

That is not the only circumstance in which persistent late payment may be found. The LTB also notes an exception where a payment was applied to another amount owed, such as arrears.

If you’re buying a tenanted property to live in, discuss possession before you make an offer.

Ontario has a process for purchaser’s own use, but it has specific requirements. The purchase agreement, type of property, intended occupant, notice and compensation all matter. An N12 notice is not a guarantee that the unit will be vacant on closing.
