An assignment of contract in real estate is a transaction of a home in which the buyer of the property “assigns” or transfers their rights and obligations of the Agreement of Purchase and Sale previously agreed to another buyer before the original buyer closes on the property. In this case, because completion has not occurred, they are not the legal owner for the property yet, thus they require consent from either the seller or the developer(often times the developer).

Assignments often occur when a presale has appreciated significantly in value prior to completion. The current buyer would like to take the appreciation (often called a “lift”) while it’s up, and assign it to another buyer.

This can occur in both resale and presale homes; however, assignments are most commonly found in presales where there is a longer closing, often 5 years away.

If your a foreign buyer but you plan to get your permanent residency in the near future you may be exempt from having to pay the 20% foreign buyers tax, as long as you get your PR before the completion date.

In B.C., the foreign buyer's tax is 20% off the fair market value of the real property and applies to foreign buyers.

If you’re a foreign buyer you pay an addition when you register the property. If a foreign buyer signs the original contract, but then assigns the contract to a Canadian citizen or permanent resident before the property is registered, the additional tax won’t apply. However, penalties may be applied if there is proof the assignment was done for tax avoidance purposes.

𝙎𝙚𝙫𝙚𝙣-𝙙𝙖𝙮 𝙧𝙚𝙚𝙘𝙞𝙚𝙚𝙞𝙀𝙣 𝙥𝙚𝙧𝙞𝙀𝙙 📋

Legally required by the Real Estate Marketing Act, there is a seven-day period from an accepted contract to allow for a purchaser to do their due diligence of reading the disclosure statement and ensuring this is the best purchase for their individual needs before committing to the purchase. After the seven-day period, the contract becomes firm and binding.

⏱⏱ Just SOLDDD! 🔥🔥🔥 Big Congrats to my Sellers for allowing me to list their home! This was a bit of a challenge since last few units in this building were not able to sell and were taken off the market.🙅🏜‍♂ I was determined to make this sale happen! 😀I had to pull all the strings in order to get it sold. Whether it was showing the property within 24 hours of a getting a notice, flyering the near by neighbourhood or advertising online to get the most eyes on it. 👀
Not only was I able to sell their home within a few days of it hitting the market I was able to get them an extra $20,000 in their pocket enough to buy a brand new 2022 Toyota Corolla.🕺
