🚨 A Real Pre-Construction Case

Many buyers assume they can simply walk away from a pre-construction purchase if the market declines.

In reality, the consequences can be severe.

A couple agreed to purchase a pre-construction condo for approximately $800,000 during a strong real estate market.

By the time the project was ready for closing, the property’s value had dropped significantly. The buyers decided not to complete the purchase.

The result?

⚖️ The court ordered them to pay approximately $144,000 in damages related to the developer’s resale loss.

This case is an important reminder that a pre-construction agreement is not merely a reservation—it is a legally binding contract.

🚨 یک پرونده واقعی از بازار پیش‌فروش آپارتمان

❌بسیاری از خریداران تصور می‌کنند اگر قیمت ملک کاهش پیدا کند، می‌توانند به سادگی از قرارداد پیش‌خرید خارج شوند.

اما واقعیت همیشه اینطور نیست:

📈 زوجی در دوران رونق بازار، قراردادی برای خرید یک واحد پیش‌فروش به قیمت حدود ۸۰۰ هزار دلار امضا کردند.

📉با کاهش قیمت‌ها و رسیدن ارزش ملک به حدود ۶۵۰ هزار دلار، آنها تصمیم گرفتند خرید را تکمیل نکنند.

😞تصمیمی که بسیار گران تمام شد.

⚖️ دادگاه آنها را به پرداخت حدود ۱۴۴ هزار دلار خسارت بابت زیان فروش مجدد واحد محکوم کرد.

✅این پرونده یک یادآوری مهم برای خریداران پیش‌فروش است:

One of the biggest mistakes many buyers make:

Buying a bigger house in a weaker location…While in many cases, a smaller home in a better neighborhood is the smarter long-term decision.

Why?

✅ Better schools
✅ Better neighbours and Safer environment
✅ Fewer rental properties in the area
✅ Higher buyer demand, Easier resale in the future
✅ Lower risk of price decline
✅ Better long-term appreciation
✅ Better quality of life for families

Many buyers focus only on square footage,
but experienced investors focus on LOCATION first. Some buyers even purchase larger lots
hoping builders will eventually buy them at a premium But in many areas today, new construction projects simply do not make financial sense, and demand for luxury rebuilds is limited.

A bigger house in a weaker area may look attractive today, but when it comes time to sell, the market reality becomes clear.

In today’s market, good locations still attract buyers. Even in slower markets, properties in stronger neighbourhoods usually sell faster and with less price reduction.

Of course, every situation is different, and every purchase should be based on personal finances, goals, and lifestyle needs.

But in many cases:📍Better location
is more important than bigger size.
