🏢 TSCC 2977 – Rosedale on Bloor | CAT Case

Can a condo corporation refuse an owner’s Request for Records because of potential litigation? Yes, in certain circumstances.

After a water leak resulted in chargebacks and liens exceeding $55,000, the owner requested investigation reports, invoices, photos, and technical records.

CAT found that the corporation could withhold certain records under the actual or contemplated litigation exception in s. 55(4)(b) of the Condominium Act.

⚖️ Key takeaway: A lawsuit does not need to have already started. However, there must be a reasonable basis for contemplated litigation, the requested records must relate to it, and the decision to withhold them must be reasonable.

The corporation also requested up to $4,356.01 in costs, but CAT awarded no costs to either party, noting that owners should not be penalized simply for pursuing their rights in good faith.

🚨 A $5 toilet part turned into a $42,000 repair bill.

This is an important reminder for every condo owner — and tenant — to know where the water shut-off valves are located in your unit.

In this case, the shut-off valves servicing the unit were the owner’s responsibility to maintain and repair. After receiving a repair bill of approximately $42,000, the owner challenged the condominium corporation and ultimately took the dispute to court.

However, the condominium’s declaration clearly set out the owner’s repair and maintenance responsibilities. This is another reminder of just how important it is for condo owners to understand their corporation’s declaration and know what components they are responsible for.

💧 Most importantly, know where your unit’s water shut-off valves are located and how to operate them. If you’re unsure, contact management or concierge and ask whether the building superintendent can show you.

And if a shut-off valve is seized or cannot be operated properly, don’t force it or attempt a DIY repair. Contact management and use the building’s plumber.

A $5 DIY repair can become a $42,000 problem very quickly when water is involved.

Know your shut-off valves. Know your responsibilities. And know your condo documents. 🏢💧
