🏡 Buying a House in a De Facto Union: What Every Couple Needs to Know

Buying property with your partner is a big step, but did you know that de facto spouses in Quebec do not have the same legal protections as married couples?

Since **June 30, 2025**, the parental union regime automatically applies to couples who have a child born or adopted after that date. This regime offers several protections: sharing of the family patrimony, rights over the residence, and even an inheritance share in the event of death.

For couples without children or with a child born before this date, nothing is automatic — you must plan for protections:
* ✔️ **Cohabitation agreement** (contrat de vie commune)
* ✔️ **Indivision agreement** (convention d’indivision)
* ✔️ **Will** (testament)
* ✔️ **Protective mandate** (mandat de protection)

* If your name is not on the **notarized deed**, you are **not the owner**, even if you are paying for the house.
* In the event of separation, the law does **not** provide for the automatic sharing of patrimony: everything depends on what you have planned together.
* In the event of death without a **will**, your de facto spouse does **not** automatically inherit.

Acheter une propriété avec votre partenaire est une grande étape, mais saviez-vous que les conjoints de fait n’ont pas les mêmes protections légales que les couples mariés au Québec?

Depuis le 30 juin 2025, le régime d’union parentale s’applique automatiquement aux couples ayant un enfant né ou adopté après cette date. Ce régime offre plusieurs protections : partage du patrimoine familial, droits sur la résidence et même une part d’héritage en cas de décès.

Pour les couples sans enfant ou avec un enfant né avant cette date, rien n’est automatique — il faut prévoir des protections :
✔️ contrat de vie commune
✔️ convention d’indivision
✔️ testament
✔️ mandat de protection

đź’ˇ Important :

Si votre nom n’est pas sur l’acte notarié, vous n’êtes pas propriétaire, même si vous payez la maison.

En cas de séparation, la loi ne prévoit pas le partage automatique du patrimoine : tout dépend de ce que vous avez prévu ensemble.

En cas de décès sans testament, votre conjoint de fait n’hérite pas automatiquement.

Pour vous protéger :
