🏡 Stigma vs. Latent Defects – Know the Difference!

Not every issue with a property must be disclosed. In BC, stigmas (such as events or perceptions that don’t affect the physical condition of a home) are generally not legally required to be disclosed. However, material latent defects that could impact a property’s safety, value, or intended use must be disclosed.

💡 If you have concerns about a property, discuss them with your REALTOR® so they can make the appropriate inquiries during your due diligence.

🚨 BC Landlords: Be Careful Before Withholding a Security Deposit! 🏠⚖️

Many landlords believe that if they deduct only a small amount from a tenant’s security deposit without the tenant’s permission, the worst-case scenario is simply paying that amount back later.

❌ That’s not how the law works in British Columbia.

Under the Residential Tenancy Act, once a tenancy ends and the tenant provides their forwarding address in writing, a landlord has 15 days to do ONE of the following:

✅ Return the full security deposit (plus any applicable interest); or
✅ Obtain the tenant’s written agreement to keep part of the deposit; or
✅ File an application with the Residential Tenancy Branch (RTB) to claim against the deposit. (BC Laws)

⚠️ If a landlord deducts money without the tenant’s written authorization and does not file an RTB application within the required time, the consequences can be much greater than many people realize.

For example:

💰 Security Deposit: $2,000
💰 Landlord deducts: $200
💰 Refunds: $1,800

Many landlords assume the worst-case outcome is paying back $200 (or perhaps $400).

🚫 Incorrect.

In many cases, the landlord may lose the right to claim against the deposit and could be ordered to pay double the entire security deposit, not just double the amount withheld. (BC Laws)

📌 The lesson is simple:
Never make deductions from a tenant’s security deposit unless:
✔️ The tenant has agreed in writing, or
✔️ The RTB has authorized the deduction.

Understanding the rules can help landlords avoid costly mistakes and unnecessary disputes.
