Royal Elm Private Co-Tenancy Association

The 19 homeowners of Royal Elm Private form the Royal Elm Private Co-Tenancy Association (REPCTA). In addition to owning their individual properties, each owner owns a one-nineteenth share of the shared lands. These lands consist of the street, shared utilities under the street, visitor parking area, the walkway connecting the street with Hunt Club Road an

d the lands adjacent to city properties on Hunt Club and Albion Roads. Responsibility for maintenance of these areas are shared by all the homeowners by contributing equally to a common maintenance fund. To save on maintenance costs, some owners maintain areas of grass adjacent to their properties. Financial and maintenance tasks are handled by an executive committee consisting of a President, Secretary and Treasurer. At minimum, owners hold an annual general meeting to elect executive officers and decide on financial and other issues such as maintenance of the shared areas and parking problems.

Royal Elm Co-tenancy Association is located in the South Keys shopping area of Ottawa - South. This a major node for shopping and regional transportation including quick access to the Ottawa airport parkway. A number of seniors homes and clinics are available nearby.

Not a Condo/Condominium

Royal Elm Private is a Co-Tenancy Association, NOT a Condominium Corporation. The two are similar in that both have common property that all owners share. A Board of Directors is elected in both cases by the homeowners to oversee management of the common property and the funds collected to maintain the common property.

One difference between a Condominium Corporation and a Co-Tenancy Association is that Condominiums share common building elements (ie. your outside wall might be part of the Corporation whereas your inside wall is owned by you personally). In a Co-Tenancy you own the full structure of your home and your yard, including your driveway. The Association together owns things like the road, visitor parking area, walkway and the utility lines under the property.

A second difference in Ontario is that legislation governs Condominium Corporations. No such explicit legislation has been passed for Co-Tenancy Associations.

Residents of the Royal Elm Private Co-Tenancy Association are governed by a Co-Tenancy Agreement. The Agreement is a recognized legal document. Every homeowner who buys a house in this community is subject to its' conditions and agrees to abide by its' Rules and Regulations. The agreement governs shared financial expenses and collection, property standards and the use and maintenance of shared lands such as the street and the visitors parking area.

Royal Elm Private, founded in 1994, is a co-tenancy association consisting of 19 single homes. It is a cul-de-sac tucked away at the rear of Royal Oak Court in the southwest corner of Greenboro in Ottawa's convenient south end. The community was built by Lisgar Square Developments Inc. VIP Construction and Engineering Ltd. built the homes between 1994 and 1997. The homes are so-called 'adult lifestyle' bungalows designed with mature couples in mind. Most homes have two bedrooms - master and guest - and some have a loft.
