Your home sold guaranteed or I’ll buy it for cash, explained.

Do you think this is bait and switch or does the concept appeal to you?

Notice the asterisk after the guarantee!

Nowadays the guarantee program has many variations.

Your home sold guaranteed or:

I’ll sell it for free- How much faith could you put into that when the listing agent couldn’t sell with the incentive of getting paid?

I’ll give you a gift certificate- you want a certificate or someone who is going to sell your home?

I’ll buy it for cash! - I know of one home ever purchased by the listing agent with this program. It happened when the program was first created over 25 years ago. It was quickly refined with new qualifying filters to ensure it wouldn’t happen again.

Once it was fine tuned this is how the original guarantee worked.

If you failed to accept any of the terms you were disqualified from the guarantee.

The listing agent would give you their market value. The guarantee purchase price would be 90-95% of this market value.

At the time of signing the listing documents, you would also sign two price reductions.

The first would take effect anywhere from 1-2 weeks after going to market.

The second would follow in about 1-2 weeks after that.

If you received an offer and didn’t accept it, you no longer qualified for the guarantee.

You had to purchase one of their listings.

No matter how many listings the agent and their team had, this still limited you with options.

If you purchase a home listed by anyone else, you no longer qualify.

I personally feel like it’s a bait and switch concept which doesn’t align with my business model.

Landlord raises rent by $500 a month upon lease renewal! And it’s legal!

If you’re a tenant seeking to lease a residential property know the difference!

Any property first occupied beyond November 15, 2018 is exempt from rent control.

If you want to be protected then look at options occupied PRIOR to the above date.

You can go with my suggestion of a clause for rent escalation but it’s not guaranteed.

When I spoke to the Landlord and Tenant board they stated there is no precedent in their courts if this would hold weight but it can be disputed.

They do encourage to put something into your lease agreement but no guarantees for either party since it’s a newer part of the act.

For legal advice on this matter please consult with a lawyer.

“But it’s on a signed contract” you might be thinking.

Often clauses such as tenant agrees to provide post dated cheques, no pets, or tenant pays the first $### amount of any repairs. These are not enforceable terms as they contradict the Landlord and Tenant Act which supersedes any discrepancy.

A landlord must provide at least 90 days written notice for any rental increase.

The increase can only become effective once the full year has passed and only once in that year.

There are exceptions such as:
-Vacant residential units
-community housing
-long care homes
-commercial properties
