Closing is the last step in transferring ownership, and sellers have important responsibilities to fulfill. Iโ€™m selling my home, and my real estate agent will be taking a vacation soon. Should I be concerned?

Thatโ€™s a great question โ€“ especially given that your property listing can be on the market anywhere from several weeks to several months.

Itโ€™s also a timely question. With the warmer months right around the corner, it is common for people to take a break to go on vacations for leisure and relaxation with family and loved ones โ€“ whether thatโ€™s to another country, another city or simply their cottage up north. Real estate agents are no different.

So, the short answer is no, you donโ€™t need to be concerned.

I appreciate that it can feel stressful for a seller if their home is listed on the market and not sold yet. However, please know that agents are licensed professionals and have the resources and infrastructure to support real estate transactions even in their temporary absence.

My partner and I are divorcing and selling our home. Can we hire separate real estate agents?

Yes, you can.

Selling a home during a divorce can be an emotionally taxing and daunting experience for many, but the right professional can help.

Generally, itโ€™s simpler if you can both agree on one real estate agent. However, if that is not feasible, then you can go about it two ways.

The first option is working with two brokerages to list your property. This is known as a co-listing agreement, also occasionally called a co-brokerage agreement.

This approach can work very well in helping both individuals work through the sale of their home while also protecting their interests. In this scenario, each party has their own designated agent from a different brokerage.

When entering into a co-listing agreement, it is important to note that while the two brokerages will provide their services separately, they will still need to work closely together.

So, give some thought to how you would like the brokerages to divide the services necessary for the sale, and have it documented. For instance, maybe one brokerage can manage the showings while the other will take care of advertisements. They both will review offers with your interests in mind.

The agreement should specify the services each brokerage will provide including the total commission you have agreed to pay (and whether itโ€™s 50/50 or some other split), and how that will be divided between the two brokerages.

When picking agents, I would encourage you to inquire about how the brokerages will handle the co-listing. Some things to ask are how they will list, market, and show the property; review the offers, and negotiate the closing date of a sale and other terms of the agreement, including price and conditions. Ideally, seek an agent who has experience with co-listings that involve the disposition of a matrimonial home.

Another option you may wish to consider is having two separate agents who work for the same brokerage. From an optics perspective, this will look like a typical sale to prospective buyers. It will also be more convenient for the agents to talk with each other. This in turn will make it a smoother and possibly quicker experience for you.

That said, it should be made clear in writing that each agent will communicate exclusively and directly with the spouse they are representing and that spouseโ€™s lawyer would be included in the process. However, please bear in mind that if the divorce is not amicable, one brokerage may not be able to effectively represent both spouses due to conflict of interest.

Regardless of how you decide to proceed, please keep your lawyer in the loop and note the fundamental steps to selling a home remain the same.

As with any legally binding agreement, it is of course important to review all the fine print before you sign. So, I would suggest that you also consult with a lawyer who is insured to practice real estate law before making any final decisions.

My spouse and I are retired and want to downsize. Where should we begin?

Downsizing is a big decision. As you make the move from your current home to a smaller one that is more suitable for your lifestyle and needs, there are steps you can take to help make sure that you are content with your real estate transactions โ€“ selling your existing home and buying your new one.

Reflect on what you want in your next home. Do you entertain a lot? Do you have a lot of guests visiting from out of town? Do you want minimum upkeep? Do you like to garden? Answers to questions like these will help you decide whether you want outright ownership, or a condominium, and if you would like a townhouse or apartment. Some condos have common areas you can use to entertain and rooms for overnight guests. As a snowbird, you might prefer the turnkey benefits of a condo and ease of access well into your old age.

Before setting your current homeโ€™s listing price, ask your agent for a comparative market analysis. This provides data on comparable properties that have recently sold or are currently selling in your area, which will give you a better pulse on what a prospective buyer should pay for your home, as well as help inform your strategy to achieve a good selling price.

Get expert advice before signing documents. Given that real estate agreements are legally binding contracts, ensure you thoroughly review and understand all the terms and conditions.

If you donโ€™t want your antique chandelier, for instance, to be included as part of the home sale, ask your agent to clearly exclude those items in the sale agreement. On the flip side, if you really like the kitchen appliances in the new property you are buying, ask your agent to outline those in the purchase agreement.

Regardless, I strongly recommend seeking the counsel of a real estate lawyer who can review the documents, confirm title and complete the transaction.

Which parts of a home are best to renovate?

That is a great question, especially given how expensive and time-consuming renovations can be. The short answer is that it depends on what you are trying to achieve.

Here are some common reasons that drive homeowners to renovate.

Enhancing functionality and enjoyability for personal use. In this scenario, I would encourage the homeowner to audit their home to see whatโ€™s working and what isnโ€™t for them, as well as what they need and what would be nice to have.

Some things to think about when determining this are how many people live in the house and if the space adequately meets their lifestyle preferences. If it doesnโ€™t, what is it lacking? Is it storage, space to entertain, a home office or all of the above? Do they cook a lot? Is the dรฉcor of certain spaces dated and needs sprucing up? Answers to these questions will inform what changes to make to the property to make it more functional and enjoyable for them.

Having said all that, one thing I would like to flag is that there is often an assumption that the more renovations are made, the more the value of a property will increase. However, that may not always be the case. For certain upgrades, the answer will be yes. For others, it will be no. In fact, some renovations can even lower the value of a home. For example, turning a two bedroom into a one bedroom home typically would reduce its value.

Upgrading a home to create more equity when itโ€™s ultimately sold. There is plenty that can be done to increase the monetary value of a home. Generally speaking, having updated bathrooms and a kitchen, as well as a finished basement might add value to a home. Additionally, having energy-efficient appliances, freshly painting the space, and beautiful landscaping will also help make the property more sellable, but might not add appreciable value to the sale price.

Buying an investment property to get the best return. Some people will buy fixer upper properties to renovate and sell or create a basement apartment to generate additional income. If this is something you are interested in, hire a real estate agent and let them know about your intentions. They can provide valuable guidance on what to look for in a suitable home.
