Changes in the BCN rental laws YOU NEED to know in 60 seconds!
1. The length: Yes, size does matter! Skipping the particulares, contracts are essentially now 1-5 years if the owner of the flat is a private citizen, and 1-7 years if the owner of the flat is a company. Before now the contracts had been 1-3 years.
2. Extension: After the initial 5 or 7 year period, if not cancelled the contract will tacitly extend for 3 more years (it used to be 1 more year), unless the tenant gives 2 months notice, or the owner gives 4 months notice that the contract should end.
3. Adios ITP! The dreaded ‘ghost’ tax will be no more. If you are renting a established and permanent residencial property then you are exempt from paying the tax.
4. If the property is being rented by a company than the agency commission should be paid solely by said company. If the property is rented by a private person or ‘particular’, then the old model, where the tenant pays, stays. This is a big shakeup and if you’d like to know a workaround contact us.
5. Deposit control: No matter what kind of contract, the owner can only legally ask for up to 3 months total deposit. 1 month of legal deposit and up to 2 months max of additional guarantee.
