Several international clients have asked us this month whether Spain has banned evicting tenants who earn under 1,800 euros. Here is the accurate picture.
A decree did extend the suspension of evictions for vulnerable households. But Parliament did not ratify it, and it was repealed on 26 February 2026. As of today that moratorium is not in force, and suspended evictions can resume.
Two points worth keeping clear. The 1,800 euro figure was the vulnerability threshold inside that rule, not a general ban. And ordinary law still allows a judge to pause an eviction for a limited time when vulnerability is proven.
If you own or plan to buy property in Spain, speak with your lawyer before acting on something you read on social media.

🚨 MORE UNREGISTERED BRITS IN SPAIN ARE APPLYING FOR THE NEW MIGRANT AMNESTY

A surprising trend is emerging in Spain.

We can confirm that many British nationals who never regularised their residency after Brexit are now applying under Spain’s extraordinary migrant regularisation programme.

Many of these cases involve people who:
✔️ Overstayed the 90-day rule
✔️ Failed to obtain residency after Brexit
✔️ Lost or failed to renew a previous residence permit
✔️ Never documented their rights under the Withdrawal Agreement

However, this does NOT mean that every British citizen living in Spain without paperwork will qualify.

Each case must meet strict requirements, and in many situations there may be alternative routes available through previous residency rights, family connections, employment or protections under the Withdrawal Agreement.

Spain’s regularisation programme, which could affect hundreds of thousands of undocumented migrants, is scheduled to close on 30 June 2026. Applicants generally need to prove residence in Spain and have a clean criminal record.

If you are a British citizen living in Spain and your residency situation is unclear, now is the time to seek professional advice before deadlines pass.
