The latest updates about a License of First Occupation

In my previous blog post, I explained what a License of First Occupation is and why it is so important to have it. Today I want to share with you the updates in regards to obtaining of LFO.

The great news is on April, 13th 2020 the Andalusian authorities announced a new Decree about a procedure of granting LFO, and now it will be speeded up. All Town Halls on Costa Del Sol will be issuing LFO to any property developers/ owners through a simple Application named «Declaration of responsibility» and instead of waiting for 6 months as before, now it takes less than 1 MONTH.

How does it affect the property market?
As I’ve mentioned before, without having LFO developers cannot sign a title deed in Notary, and even if the new development is already built and ready, new owners have to wait for the license, approximately 6 months, before they could move in.

FROM NOW ON YOU CAN MOVE IN YOUR NEW PROPERTY AS SOON AS BUILDING WOKRS ARE FINISHED, SO THERE IS NO NEED TO WAIT.

What to consider before you make a down payment🧐?

If you have found the house of your dreams on Costa del Sol and are ready to go on with the purchase, make sure your future property has all the required documents in place. One of the main documents to take into account is a License of First Occupation or LFO.
Have you ever heard of it?

All properties, both on re-sales market and new built should have LFO. If a property is older than 15 years, a license may have a different name, but should equally exist, it also may depend on location and the town hall issued.
The property developer is responsible for applying for this license once he gets the Certificate of End of Construction, also issued by Town Hall. Each newly built dwelling will have an individual License of First Occupation (LFO), although in large developments the LFOs are normally grouped for economies of scale.

Why this document is so important?

The LFO allows the purchaser to dwell in the property legally. Basically, LFO confirms that the property corresponds to all legal normative and requirements.

If a long period of time has passed since the building works were completed and the developer has failed to obtain this license, it may be a sign of serious underlying legal problems. Although it is not illegal to complete a purchase at the notary, banks will not grant a mortgage, also it will prevent you from having access to water and electricity utilities for the property.

The main inconvenience about LFO is the amount of time that Town Halls takes to issue it, sometimes it may last more than 6 months. And the fact that despite your new home is already built and ready for you to move in you have to wait is really annoying! So, what should you do?
