Some of the features to look for in a trusted real estate agency are:
They belong to a professional associations or Colegio such as the API & APIVA.
They are registered in the State registry if required, each state of Comunidad has different rules for real estate agents.
They have a physical office, they have a transaction history and can provide references, they carry liability insurance and are transparent in all dealing.

There are three common approaches in determining the value of a property:
The Comparable Value Method: this method looks at similar properties on the market and recently sold. Properties that are short listed to compare will be in the same neighbourhood, have similar features and size.
The Income Method: this method looks at rental income the property can obtain based on current renal incomes of similar properties. The yearly income is then multiplied by a cap rate.
The Construction Method: this method looks at plots of land in the target area and then looks at the construction costs of building a similar property. This method is primarily used to determine the value of a house.
Official valuations in Spain are conducted by registered tasadores who will produce a ‘Tasacion’

Yes, you can rent out your second home in Spain.
There are three types of rentals:
The short-term or tourist rental which is regulated by the city and needs a licence, each city has different regulations.
The mid-term rental which is under 11 months.
The long-term rental which is one year, extended up to 5 years and 7 years if a company owns the property. Long-term rentals are regulated by the state and fall under the LAU, Ley de Arrendamientos Urbanos. These rental leases protect the tenants.

In Spain, the listing agent represents the seller who has given the mandate to sell the property. Many times, listing agents will also charge the buyer, but do not represent the buyer’s interest in the transaction. When purchasing a property in Spain, it is advisable to always have your own representation. Buys Side or Buyers Agents will represent your interest in a purchase.

There are two property registries in Spain:

The Registro Catastral or Catastral Registy, which is an administrative registry that maintains the physical and fiscal detail of all properties in Spain. Every property in Spain has to have a ‘referencia catastral’ a 20-character identifier.

The Registro de la Propiedad or Property Registry, maintains and provides official records of ownership and legal encumbrances. This registry provides legal certainty to owners and third parties ensuring the registered right are protected. The Nota Simple is an excerpt of the property registry which shows the owners and legal encumbrances such as a mortgage.
