🔐 DATA PROTECTION IS CHANGING — AND LETTING AGENTS NEED TO TAKE NOTE

GDPR hasn’t gone away, but the Data (Use and Access) Act 2025 introduces important changes to how businesses handle personal data.

For letting agents, this matters because we regularly deal with sensitive information from landlords, tenants, applicants, guarantors and contractors.

🏠 What should letting agents be aware of?

✔️ New requirements around handling data protection complaints
✔️ Changes to how Subject Access Requests (SARs) should be dealt with
✔️ Greater clarity around what constitutes a reasonable and proportionate search
✔️ Updates to how personal data can be used and processed
✔️ The need to review internal data protection procedures and privacy notices

The new complaints requirements are particularly important. Organisations must provide accessible ways for people to make data protection complaints, acknowledge complaints within 30 days, and respond without undue delay.
