Most peoplle have heard of the concept of Localism i.e. taking decisions about local matters at a local level. However, do users of the planning system really undertsand what that means? For most householders it means the decision on a planning application being taken by an unaccountable member of staff at the local council. The perception of fairness is somewhat lost. In a recent case, regarding two roof dormers Pearson Planning, Chartered Surveyors represented Mr & Mrs M. Their architectural adviser had been trying to obtain planning permission. The power rested with Officers involved, and despite making changes to the design, permission was refused. With no automatic right of appeal in Scotland, Pearson Planning represented Mr & Mrs M when seeking a re-assessment by the Local Review Body. Councillors on the Body took no oral evidence, dismissed the matter without debate, in line with the recommendation of the Chair. Frustrated, Mr & Mrs M reapplied for exactly the same proposal on the advice of Pearson Planning, Chartered Surveyors. This time, as local residents & neighbours had written in support, the application was dealt with by Committee. The Committee has a diferrent Chair than that of the LRB. The Committee heard Euan FS Pearson and debated the proposal. Councillors decided to grant planning permission without voting. It must seem to the on-looker that planning is a Game, and the outcome depends on who is on the Throne.

Pearson Planning, Chartered Surveyors has obtained planning permission for a agricultural worker’s dwelling, for a cereal crop farmer, on His holding, in the countryside. On realising the famer was staying in a house in the nearby market town, the Planning Officer was not inclined to grant permission. Apparently farms can be run remotely with no labour requirement. Almost as funny as an 1930s american comedy.

Pearson Planning, Chartered Surveyors demonstrated that the business was productive, profitable, sustainable and had more than sufficient labour requirements for on site management. The local planning authority had previously accepted two Prior Notifications for grain stores and these had been built. The grain is supplied to a multi national drinks company for vodka production.

THE DISRUPTION IS FINALLY OVER

In May 1843 the Disruption started. There was split in the Presbyterian church in Scotland. New places of worship were constructed, including the Maryhill High Church in Glasgow. That congregation merged in the 1990s and the Church & Halls were sold. The purchaser converted the listed building into a house & started a childrens’ nursery in the Halls. Glasgow City Council authorised these works.
In 2011 Glasgow City Council served an Enforcement Notice requiring reinstatement of part of the Church spire, removed on the basis of safety. In 2016 Glasgow City Council reported the owner to the Procurator Fiscal for non compliance with the Notice. The Fiscal brought a case to the Sheriff Court causing major disruption in the lives of the owners & occupiers.
Pearson Planning, Chartered Surveyors was instructed, and applied to have the Church & Halls removed from the List. Historic Environment Scotland, despite protests from GCC, agreed, and the Church & Halls was removed from the list of buildings of special architectural/historic interest. The case against the Owner was dropped and court proceedings stopped.
One Hundred & Seventy Four years later, the disruption was finally over.

'TILL THE COWS COME HOME

Farm owners, who employed a Farm Manager (rather than Farm themeselves) can remain in their purpose built Farmhouse, following the issue of a Certificate of Lawfulness.

Planning permission was granted by Scottish Ministers in 2004 for the construction of a Farmhouse and two dwellings for agricultural workers, on a 555ha Holding. The Holding had been created by subdividing another Estate. The Holding was used for crop production and beef cattle but the owner lived elsewhere. Planning permission was granted with an occupancy restriction (person solely/mainly/last employed on the Holding.

Pearson Planning, Chartered Surveyors obtained a Certificate from the local planning authority after demonstrating that the occupancy condition had not been complied with for a period of more than 10 years. This, in law, made it impossible for the Condition to be enforced. The occupants of the Farmhouse owned the Farm business but were not employed by the Business. This case highlights the importance of imposing clearly written conditions that satisfy all the legal tests.

The Businessman and Family can remain living in the farmhouse well after the cows come home.

Pearson Planning, Chartered Surveyors has now doubled the value of the property, as it no longer has any agricultural occupancy condition, and can be sold on the open market.

The people of Monifieth will be seeing a new Church on the town’s High Street in the next few years. Planning Officers at Angus Council originally refused planning permission for construction of the new church. However, on application to the County’s Local Review Body, Pearson Planning,Chartered Surveyors obtained conditional planning permission. The LRB voted 5-0 to grant permission. The Planning Officer, Ruari Kelly, came in for particular criticism. Planning permission was originally refused on the basis that the Mr Kelly did not want the existing buildings demolished. Demolition of a building that is not ‘listed’, outside a Conservation Area, doesn’t need the approval of the planning authority. The Congregation of Monifieth Parish Church of Scotland intend to open the new Church with its meeting rooms & garden in 2017.

WASTE MANAGEMENT & RECYCLING FACILITY TO EXPAND OPERATIONS

Pearson Planning, Chartered Surveyors has obtained consent, for a leading UK recycling company, to expand its operations. Although no new building is involved, the A.R.C.A accredited Company is now able to receive & process a wider range of waste.

Pearson Planning, Chartered Surveyors persuaded the local planning authority to remove a planning condition, that restricted handling to demolition/construction arisings. Total Recycling now plans to treat industrial, commercial & domestic waste.

The UK is reportedly not reaching its landfill targets set by the European Commission. About 75% of municipal waste goes to landfill (source BBC). Total Recycling's new activities will help increase this.

NEW BARISTA BAR & FUNCTION HALLS TO OPEN, DESPITE OPPOSITION FROM LABOUR PARTY

Pearson Planning, Chartered Surveyors has obtained permission to reopen the former Royal British Legion Club in Whitburn, as licensed premises. Labour Party councillors voted to refuse planning permission on the grounds of impact on residential amenity. However, Scottish Ministers allowed the appeal, submitted on behalf of Pearson Planning's client Warrington Property. Scottish Ministers found that there was no evidence to suggest that reopening as a public house would be any different from running a Club bar. Police Service of Scotland and the local Environmental Health Manager did not object to the reopening. The Whitburn Club closed due to falling patronage, blamed partially on the prohibition of smoking in enclosed places. HOUSEBUILDER SAVED FROM PAYING "UNFAIR" PLANNING OBLIGATION

Borders Council has been told by the Scottish Ministers that it was “unfair” to require the developer of Vinery Park, Clovenfords to pay £70,000 towards road network schemes. Pearson Planning, Chartered Surveyors advising Barratt Homes, submitted an appeal, following Borders Council’s unwillingness to justify the payment. Vinery Park is a development of family homes off the A7, north of Gala. Borders Council wanted money to pay for a wish list of road ‘improvements’, including a £10m crossing of the River Tweed at Gattonside. The Reporter appointed to determine the appeal agreed with Pearson Planning’s position that the financial demand failed 3 legal tests. He deleted the obligation from the Legal Agreement signed in 2008. If you believe you have signed up for planning obligations that are not reasonable or necessary, then why not contact us?

SCHEDULED MONUMENT CONSENT GRANTED FOR WORKS TO LONDON SITE

Pearson Planning, Chartered Surveyors has obtained Consent from The Secretary of State to excavate beneath Governor's House, the site of Roman ruins, in the City of London.

The Building is the headquarters of Prudential plc. The multinational insurance provider with 7million customers in the UK. The excavations are required to allow a connection to the Vodafone telecoms network.
