A forthcoming statutory instrument, The First-tier Tribunal (Property Chamber) Fees (Amendment) Order 2026, is expected to introduce a £47 fee for tenants to challenge rent increases, including those under Section 13.

The SI is not yet in force, but it signals a clear policy direction. This raises a simple question: should tenants have to pay to challenge a rent increase?

While some will argue any fee risks limiting access to justice, a modest charge may also serve a useful purpose by discouraging speculative or tactical challenges and ensuring the tribunal system is used for genuine disputes.
