The written statement deadline is understandably attracting much of the attention at present, with just 12 days remaining for landlords and agents to prepare.
However, another important change must not be overlooked — the new Section 13 rent increase process.
Over the next twelve months, every landlord in England wishing to increase rent during a tenancy will need to use a Section 13 notice. For many landlords, this will be unfamiliar territory. Previously, rent increases were often agreed through a tenancy renewal, a simple conversation, or even a straightforward email. Those approaches will no longer meet the legal requirements.
Section 13 is now the sole legal mechanism for increasing rent during a periodic tenancy, and the process leaves very little room for error.
The notice must be served using the prescribed government form — not a covering letter, email, or bespoke document. It must provide a minimum of two months’ notice and can only be used once within any twelve-month period.
Importantly, any proposed increase must reflect the current open market rental value, rather than simply following inflation or applying a standard percentage uplift, as was commonly seen previously.
Tenants also have the right to challenge a proposed increase through the First-tier Tribunal if they believe the rent exceeds the market rate.
For landlords, the practical implications are clear:
• Ensure the correct form is used
• Ensure the notice is completed accurately
• Ensure the proposed rent is realistic and evidence-based
An incorrectly served notice or an above-market increase could lead to unnecessary delays, disputes, or a formal challenge.
