Licensing vs Planning
The amount of times that I ask whether the property has the adequate planning permission and I hear โ€œWell Itโ€™s licensedโ€ is alarming.
Licensing and planning are two totally different entities, two different departments.
Licensing is focused on tenant welfare and planning to do with the building type.
- A family home has the use class C3 dwelling.
- A small house share between 3 to 6 unrelated individuals has the use class C4 dwelling (Small HMO).
- A HMO with 7 or more unrelated occupants has the use class Sui Generis (Large HMO).
Under normal circumstances you have the permitted development right to move from C3 dwelling to C4 HMO (and back) without any need to notify the council.
If youโ€™re going from a C3 dwelling or from a C4 dwelling to a 7+ occupant HMO (Sui Generis) you would need planning permission regardless.
In certain areas councils have introduced an โ€˜Article 4 Directiveโ€™ which removes this permitted development right. In these areas you will need to make a planning application if you want to house between 3 to 6 individuals to avoid being in breach of planning.
The confusion lies in the fact that you can get granted a HMO licence even if you donโ€™t have the adequate planning permission and so landlords think theyโ€™re fine.
We know numerous examples where a landlord purchases a property, does a complete renovation, gets a HMO license and down the line gets a knock on the door from planning enforcement demanding the property be reverted to its original use! You can retrospectively apply for the permission at this point but very risky if certain criteria are not met.
In our most recent case a landlord went from earning over ยฃ4000 a month when it was run as a HMO to struggling to let the same property as a single let for ยฃ2000.
This can be a very very costly mistake! If you want to future proof your asset then please ensure you have ticked all boxes.
The following London boroughs have an A4 directive in place and so would need PP if your property has 3-6 unrelated tenants (see comments)

Barking and Dagenham, Bexley, Barnet, Brent, Camden, Ealing, Enfield, Greenwich, Hackney, Hammersmith and Fulham, Haringey, Harrow, Havering, Hounslow, Islington, Kingston upon Thames, Lewisham, Newham, Redbridge, Southwark, Tower Hamlets, Waltham Forest and Westminster?
If so, there is a high chance youโ€™ll need a licence to rent out your property !! ๐Ÿ“„
All of these boroughs have some sort of licensing scheme in place. From Selective Licensing (any private rental property requires a license) to Additional Licensing (a HMO licence which is required if the property is let to 3 or more tenants who arenโ€™t related) and Mandatory HMO Licensing scheme (licence which is required if the property is let to 5 or more unrelated tenants). ๐Ÿ“†
What happens if you don't licence the property?
- You risk being prosecuted by the council and if found guilty this could lead to a criminal record and unlimited fines.
- The council could issue a civil penalty notice of up to ยฃ30k for not having the correct licence in place without warning!
- You could be subject to a Rent Repayment Order (RPO) and may have to repay up to 12 months of rental income.
- Whilst unlicensed you wonโ€™t be able to evict your tenants via section 21.

More and more boroughs are bringing this in, Enfield for example have approved the introduction across 14 wards across the borough pending government approval.
What if you dont licence the property? ๐Ÿคท๐Ÿปโ€โ™‚๏ธ

- Risk being prosecuted by the council and if found guilty this could lead to a criminal record and unlimited fines.
- The council could issue a civil penalty notice of up to ยฃ30k for not having the correct licence in place without warning!
- You could be subject to a Rent Repayment Order (RPO) whereby if the tenant suspect theyโ€™re residing in a non licenced property they can demand up top 12 months of rental income.
- Whilst unlicensed you wonโ€™t be able to evict your tenants via section 21.
