Private landlords, would your property pass a compliance check today? šŸ”

Keeping a rental property compliant involves much more than collecting the rent. You need the correct safety certificates, checks and tenancy documents in place, and missing just one could result in a substantial fine.

Your landlord compliance checklist should include:

āœ… An annual Gas Safety Certificate
āœ… A valid EICR, usually renewed every five years
āœ… A valid EPC rated E or above
āœ… Working smoke and carbon monoxide alarms
āœ… The tenant’s deposit correctly protected
āœ… Right to Rent checks for every adult occupier
āœ… The correct selective, additional or HMO licence, where required

The consequences of getting it wrong can include fines of up to £40,000, compensation of up to three times the tenancy deposit and restrictions on recovering possession of the property.

Requirements can vary depending on the property and local licensing scheme, so never assume that last year’s checklist is still enough.

Renters’ rights have changed, and the end of Section 21 has completely changed the way landlords regain possession of their properties.

But there’s one consequence that tenants might not immediately think about.

Before, even if a tenant was in rent arrears, a landlord could use Section 21 to regain possession without making those arrears the reason for the eviction. The unpaid rent could be dealt with separately.

Now Section 21 has gone, landlords need a legal ground for possession.

So if the reason is serious rent arrears, those arrears can become part of the court proceedings.

And this is where it’s important to understand the difference.

A Section 8 notice does NOT automatically give someone a CCJ. A possession order doesn’t automatically give someone a CCJ either.

But if the court also makes a money judgment for unpaid rent or costs, that can potentially affect the tenant’s credit record and future referencing.

The changes give tenants greater protection from no-fault eviction, but when a tenancy goes seriously wrong, could the financial consequences now become more visible too?

It’s something both landlords and tenants need to understand.

If you’re a landlord with a tenant already in your property, today’s possession deadline could be important. If you served a Section 21 or qualifying Section 8 notice before the Renters’ Rights Act came into force, there are strict time limits for starting court proceedings. Missing the deadline could mean having to begin the possession process again under the new rules.
