Q: Can I build a fence as high as I like on my boundary?
A: Not necessarily.
In most cases, planning permission is required for a fence, wall or gate over 1 metre high where it adjoins a road, footpath or pavement, and over 2 metres high elsewhere.
Before installing a new fence, it's also worth checking your title deeds. Many properties, particularly on open-plan developments, contain covenants restricting fence heights or prohibiting fences altogether in certain locations.
A quick check before you build could save a costly dispute later.

For centuries in Japan, rooms were measured in something far more practical: floor mats.
Tatami mats, woven straw mats made to a strict 2:1 ratio, became the foundation of traditional Japanese architecture. Instead of designing a room first and fitting the flooring afterwards, architects designed the entire space around the mats themselves.
A room wasnโ€™t โ€œ12 square metres.โ€ It was โ€œ6 mats.โ€
The result was a system built around human experience rather than abstract numbers. If someone said a room was six mats, you immediately understood how many people could sit comfortably and how the room would function in daily life.
One is a mathematical measurement.

A four year neighbour dispute involving a ยฃ1.2m property in East Sussex has reached the High Court, centred on the position of a โ€œdog-proof fenceโ€ and the true legal boundary.

What happens if your property boundary is a riverโ€ฆ and the river moves?
Surprisingly, the legal boundary may move with it.
Under long-established property law, if a river gradually shifts position over time through natural processes like erosion or sediment build-up, a principle known as accretion applies. This means the legal boundary slowly moves as the river moves.
But if the river suddenly changes course during a flood or major storm eventโ€”a process known as avulsionโ€”the boundary usually stays exactly where it originally was.
The result? Two neighbouring landowners can gain or lose land without signing a single document, simply because nature decided to redraw the map.
It creates a fascinating legal scenario: what looks like a fixed line on a title plan can actually be a boundary that moves with the landscape.

A landmark Court of Appeal ruling (White v Alder) has settled a terrifying truth for property buyers: if previous owners made an informal handshake agreement to fix a boundary line, even decades ago and never recorded on the deeds, it automatically binds all future owners.
In this case, a buyer bought a cottage with zero knowledge of a private boundary agreement made by the previous owner weeks earlier. Years later, when he demolished a boundary wall to build an extension, the neighbours sued.
He fought it all the way to the Court of Appeal, arguing it was unfair to be bound by a "secret" agreement. The court ruled against him. Because a boundary agreement fixes the actual extent of the land, you cannot buy more than the seller legally owns. Knowledge does not matter.
As an expert witness, I see how these hidden agreements blindside buyers. Before buying, extending or altering boundaries get a Chartered Land Surveyor to review title deeds, plans, physical evidence on the ground and any historical data.
The ground truth does not always match the Land Registry red line.
