𝗔 𝗽𝗶𝗰𝘁𝘂𝗿𝗲 𝗶𝘀 𝘄𝗼𝗿𝘁𝗵 𝗮 𝘁𝗵𝗼𝘂𝘀𝗮𝗻𝗱 𝘄𝗼𝗿𝗱𝘀, 𝗲𝘀𝗽𝗲𝗰𝗶𝗮𝗹𝗹𝘆 𝗶𝗻 𝗯𝗼𝘂𝗻𝗱𝗮𝗿𝘆 𝗱𝗶𝘀𝗽𝘂𝘁𝗲𝘀

When our client suspected that a neighbouring hedge was encroaching across the boundary, subjective impressions were not enough. Accurate, objective evidence was essential.
By combining high-resolution UAV aerial imagery with survey-grade ground control, we produced a precisely georeferenced orthomosaic.
We then plotted the boundary identified from the available title evidence and survey investigation onto the current aerial imagery. The resulting plan clearly showed the hedge vegetation extending across the plotted boundary and onto our client’s property.

𝗪𝗵𝗲𝗻 "𝗶𝗻𝗰𝗵𝗲𝘀" 𝗺𝗮𝘁𝘁𝗲𝗿 𝗶𝗻 𝗮 𝗹𝗲𝗴𝗮𝗹 𝗱𝗲𝗳𝗲𝗻𝗰𝗲

In recent years, we’ve been instructed in several cases regarding the exact location of the Irish border.
The core issue? Jurisdiction.
In these specific instances, individuals were arrested by the PSNI, but the legality of those arrests hinged on a single question: 𝘞𝘩𝘦𝘳𝘦 𝘦𝘹𝘢𝘤𝘵𝘭𝘺 𝘸𝘦𝘳𝘦 𝘵𝘩𝘦𝘺 𝘴𝘵𝘢𝘯𝘥𝘪𝘯𝘨?
We received bodycam footage and, through this and a subsequent site survey, ascertained that a number of those arrested were in the Republic of Ireland and outside the jurisdiction of the PSNI.

Under common law, you are generally entitled to prune branches or roots encroaching onto your property, but only as far as the legal boundary. However, taking action without checking the circumstances can quickly escalate into a costly dispute.
Key practical points to remember before cutting:
• Cut only to the boundary: Cutting beyond the legal boundary or entering your neighbour’s land without permission may constitute trespass.
• Offer back the cuttings: Branches, fruit and other cuttings generally remain the property of the tree owner. Offer them back first. If they are declined, dispose of them responsibly rather than throwing them over the boundary.
• Check legal protections: Before starting work, check for Tree Preservation Orders, conservation-area restrictions, planning conditions, felling requirements and wildlife protections. The rules differ between jurisdictions.
• Protect the tree: Excessive pruning or root cutting that kills or destabilises the tree could leave you liable for the resulting damage.

Clearly identifying the boundary can help remove uncertainty before disagreements develop into litigation.
