Periodic Tenancies

The Renters Rights ACT will remove fixed-term assured tenancies. Fixed-term tenancies mean Renters are obliged to pay rent regardless of whether a property is up-to-standard, and they reduce flexibility to move in response to changing circumstances, for example after relationship breakdown, to take up a new or when buying a first home.

Instead, all tenancies will be periodic, with tenants able to stay in their home until they decide to end the tenancy by giving two months notice. This will end the injustice of tenants being trapped paying rent for substandard properties and offer more flexibility to both parties to respond to changing circumstances, for example, after relationship breakdown, to take up a new job or when buying a first home.

With the changes under the Renters’ Rights Act coming into effect on 1st May 2026, we are revisiting some of the key points landlords should be aware of.

Some of the key points include:

▪️𝐅𝐢𝐱𝐞𝐝 𝐭𝐞𝐫𝐦𝐬 𝐚𝐫𝐞 𝐜𝐡𝐚𝐧𝐠𝐢𝐧𝐠
From 1st May 2026, assured tenancies can no longer have a fixed term. Existing assured shorthold tenancies will become rolling periodic tenancies.

▪️𝐋𝐚𝐧𝐝𝐥𝐨𝐫𝐝𝐬 𝐰𝐢𝐥𝐥 𝐧𝐞𝐞𝐝 𝐚 𝐯𝐚𝐥𝐢𝐝 𝐫𝐞𝐚𝐬𝐨𝐧 𝐭𝐨 𝐚𝐬𝐤 𝐚 𝐭𝐞𝐧𝐚𝐧𝐭 𝐭𝐨 𝐥𝐞𝐚𝐯𝐞
From 1st May 2026, landlords will no longer be able to serve a Section 21 notice. Where possession is needed, landlords will need to use Section 8 and rely on a valid legal reason.

▪️𝐒𝐞𝐥𝐥𝐢𝐧𝐠 𝐨𝐫 𝐦𝐨𝐯𝐢𝐧𝐠 𝐛𝐚𝐜𝐤 𝐢𝐧 𝐰𝐢𝐥𝐥 𝐬𝐭𝐢𝐥𝐥 𝐛𝐞 𝐩𝐨𝐬𝐬𝐢𝐛𝐥𝐞
These can still be valid grounds for possession, although not within the first 12 months of a tenancy.

▪️𝐑𝐞𝐧𝐭 𝐢𝐧𝐜𝐫𝐞𝐚𝐬𝐞𝐬 𝐦𝐮𝐬𝐭 𝐟𝐨𝐥𝐥𝐨𝐰 𝐭𝐡𝐞 𝐟𝐨𝐫𝐦𝐚𝐥 𝐩𝐫𝐨𝐜𝐞𝐬𝐬
From 1st May 2026, rent review clauses can no longer be used for new increases. Instead, rent can still be increased once a year, with at least 2 months’ notice.

As with any change in legislation, it is important to understand how this may affect your tenancy agreements and next steps.
