A Party Wall Notice has landed on your doormat. What now?

First, don’t panic. It’s a legal requirement to protect both you and your neighbor, but it MUST NOT be ignored. You typically have 14 days to respond.

You have three main paths:

1. CONSENT: You agree to the works proceeding as described.
2. DISSENT and appoint your own surveyor: This ensures your property and interests are fully protected by your own expert.
3. DISSENT and appoint an ‘Agreed Surveyor’: One impartial surveyor acts for both parties.

The right advice is a lot cheaper than the wrong advice. Crucially, in most cases, the building owner carrying out the work is responsible for paying your surveyor’s fees. You get professional protection at no cost to you.

The biggest risk in a softer market is a listing going stale.
Once buyers think a home has been “hanging around”, they start asking what’s wrong with it : and offers slide.

A good local estate agent should be able to provide the best sales approach but we are finding some vendors are not well advised on preparing the property for sale both in terms of documentation and condition. An RICS Home Survey is available for sellers as well as buyers and can reduce the chance of gazundering or fall through. A professional, realistic RICS valuation gives you a defensible asking price based on comparable evidence and current demand. The survey identifies condition and compliance issues before your future buyer does. The right advice will be a lot cheaper than the wrong advice.
