Tip 19. When selling now or in the future, start preparing your paperwork early.

The government announced last week that they have plans to modernise the home buying and selling process, with more information provided upfront, digital property records, and earlier commitments from buyers and sellers. These upfront ‘sales packs’ are expected to contain details of property condition, leasehold costs, local authority searches and the status in a chain.

The aim is to reduce the longstanding frustration with the transaction process. Currently government research has found that one in three transactions fail before completion amounting to millions in wasted costs for buyers and sellers.

By aiming to reduce delays, cut costs, and lower the number of sales collapse before completion this is very much welcomed news for buyers, sellers and property professionals.

Fail to prepare, and you prepare to fail !!

Don’t let the buyers solicitor uncover missing paperwork for that extension and a previous issue with the property title that you kept meaning to sort out 🤔

Start preparing your paperwork early:

♦️Leasehold information (if applicable)
♦️Guarantees and warranties
♦️Property information
♦️Documents a solicitor may need

Tip 18. Do not assume exchange and completion are the same thing.

One of the biggest misconceptions in property transactions is that exchange and completion happen at the same time.
While they sometimes do, especially with vacant properties or cash buyers, this is far from the norm.
Exchange of contracts is the point of which the transactions become legally binding, whereas completion is when the ownership officially transfers and the keys change hands. Between these two stages there is often a gap of days or even weeks allowing everyone in the chain to prepare for moving.

Understanding the difference helps manage expectations and reduce unnecessary stress.

So for clarity:

♦️ Exchange provides legal certainty
♦️ Completion delivers the move.

Knowing which stage you’re at and what it means can help buyers and sellers make informed decisions, avoid costly mistakes and navigate the property journey with greater confidence.

Did you know that a short lease can affect your mortgage options, future saleability and the property’s value.

If you’re buying a leasehold property, don’t just fall in love with the flat… you need to understand the lease. Details hidden in the paperwork could have a significant impact on your finances in the coming years.

Before making that commitment always check:

♦️ How many years left on the lease?
♦️ Annual ground rent / Review clauses
♦️ Service charges and what they cover
♦️ Are major works planned for the building
♦️ Cost and process of lease extension

Always investigate before you commit. That flat that you fall in love with might be perfect, but the lease could be telling a different story.

Tip 16. Always review the title plan

What you see isn’t always what you own.

Just imagine moving into your dream property and a few months down the line the neighbour informs you that the part of the garden that you thought belonged to you is actually on the neighbours land.

You check the title plan… it turns out that the boundary line was different from where the fence had been installed years earlier.

Now, you find yourself in an uncomfortable and costly dispute that could’ve been avoided before purchasing the property.

If fences, walls, hedges, driveways, or access routes don’t seem to match the legal boundaries, raise the question before you commit to the purchase.

That checking of the boundaries could save thousands in legal costs!
