This week Steve took up his place on the arbitration panel of ABTA the travel and holiday trade body and will now be arbitrating disputes between providers and consumers in the travel and holiday industry, and will be doing so under the ABTA Arbitration Rules which came into force in 2018.

Smash and grab adjudications are alive and well !!

Steve successfully brought a claim against his clients employer for non payment of an interim account, the sum was in excess of £100,000 and the adjudicator agreed with Steve’s submissions that despite the recent case of
Grove Developments Limited -v- S&T (UK) Limited (27 February 2018)

That if the employer (payer) neglects to issue a valid payless notice then the sum claimed is the sum due and that sum must be paid.

In a very recent case Masters v 6 Bolton Road ltd HHJ Edward Bailey sitting in the Central London County Court determined that despite two very well known party wall surveyors, one of whom is a Chartered Structural Engineer determining that independent engineering advice was not required to carry out stonework repairs to a balcony, the adjoining owner was entitled to seek such advice at the cost of the building owner, as the surveyors making the award had awarded this was not necessary HHJ Bailey allowed an appeal on the grounds that the “ award was wrong” he is therefore permitted to rescind or modify the award in accordance with section 10(17) of the Act.

In another recent case before him Welter v Mckeeve in November 2018 HHJ Bailey determined that a surveyor who was prima facie going the extra mile to obtain exacting constructional details and methodology for relatively simple works was right to do so.
In both cases Judge Bailey commented on the quasi Arbitral role of the appointed surveyors and expressly provided that a thorough approach by surveyors was expected by the judiciary.
