Following up on my previous post about who a landowner should talk to, the next stage is this:

What can I do as a landowner to assist? 🧭🏡

Possible restrictions to note include existing tenancies, third-party use of the land, and rights of way or utilities (such as electricity lines ⚡, gas pipelines 🛢️, water pipes 💧, or fibre optic cables 📡). Buried utilities often come with easements that constrain development. 🧰🚧

Another important consideration is to be cautious about granting tenancies that provide long-term security, as these could affect the ability to deliver vacant possession in the future. ⏳🔒

🔍 Land Use in England (as of April 2022):

- 8.7% of land was developed 🏡, while 91.1% was non-developed 🌳, and just 0.2% was vacant.
- Main land types:
🌾 Agriculture (63.1%)
🌳 Forests, open land, water (20.1%)
🌿 Residential gardens (4.9%)

- Green Belt: 6.8% developed 🏞️
- Flood Zone 3: 6.1% developed (excluding flood defences) 🌊
- High/medium flood risk areas: 5.0% developed (with flood defences) 🌧️

At the end of last week, outline planning permission for 105 new homes was granted for an 11.5-acre site in Pershore.

I am proud to have secured and negotiated an Option Agreement for the subject site on behalf of my client, TOUCH DEVELOPMENTS LIMITED, with Lioncourt Homes having achieved outline planning permission.

What is a Planning Appeal Inquiry?

It's a formal process where a third party can challenge a local planning authority’s decision. An independent Planning Inspector reviews the case through written submissions, hearings, or inquiries.

🚧 My clients are frustrated with planning permission delays applications often fail to be determined or validated for long periods. Planning departments need more staff, and I feel for the hardworking Planning Officers. 😔

Instead of addressing these issues, the Government seems distracted by ‘Get on and Build’ 🏗️, which is adding more burden on developers and housebuilders.

There are valid reasons why some sites remain undeveloped, like:
• Delays in ‘Reserved Matter’ consent ⏳
• Delays in S.178 consent 📝
• Development finance issues 💰
• Third-party rights or occupancy 🏘️
• Legal restrictions ⚖️
• No build-out despite available sites 🚧

I thought we had moved past the ‘Land Banking’ myth! 🤔
