As your managing agent, we are legally required to hold these protections, which simplifies compliance for you:
π TPO/PRS β Property Redress Scheme: Mandatory membership (like The Property Ombudsman) so tenants and landlords have an independent, fair place to resolve complaints.
π· CMP β Client Money Protection: By law, we must protect your money! This scheme ensures your rent and tenant deposits are safe and you're compensated if the agency ever went bust.
ποΈ ICO β Information Commissionerβs Office: We are registered to ensure all tenancy and financial data is handled securely and legally under GDPR. (We cover the day-to-day data handling for you!)
π What You Must Know (The Landlord's Data Duty):
If you use an agent, your data protection burden is much lighter. However, you must be aware of your role:
You Remain the Data Controller: Even with an agent, you remain the ultimate Data Controller for the core tenancy.
ICO Registration: If you personally hold, store, or process any tenant data (e.g., you keep copies of application forms, tenant emails, or maintenance notes on your personal computer), you are still required to register with the ICO and have your own Privacy Notice covering the data you handle yourself.
Agent Reliance: If you genuinely rely on El Rents to handle all tenant personal data and documentation on your behalf, your need to register is often eliminated.
