In a bid to curb the ongoing concerns with land guards, fraud and double sales in the land and property sector in Ghana, the Land Act 2020 (Act 1036) now provides specifically for these matters as a deterrent for engaging in such conduct or behavior.
Land guards can be convicted and imprisoned for a 5 to 10 year term. Those who employ them are also subject to a 10 to 15 year prison term on conviction. As the term “land guard” is not used in the Act, any persons or groups who engage in that conduct, will be liable for the punishment that is provided.
Owners who are affected by such persons or conduct can also apply for a restraining order or an injunction even if the trespassers are unknown.
Also, a seller who withholds or falsifies information can be sued for damages by the buyer and could on conviction, also pay a fine or go to prison for 5 to 10 years or both.
Anyone convicted for breaking the law on the double sale of land including individuals with no title or authority for that transaction is subject to a fine or prison time of 7 to 15 years or both.
