Educational Campaign on Ghana’s Rent Act, 1963 (Act 220)

We begin this series to clarify common misconceptions and provide accurate legal information for landlords and tenants alike.

Myth: The law grants a tenant a free three‑month grace period after a lease expires.

Fact: The Rent Act, 1963 (Act 220) contains no such provision.

When a lease expires and the tenant remains in occupation, the tenant becomes a statutory tenant and continues to be liable for rent.

Under section 17(3), a Rent Magistrate may postpone an ejectment order, but typically on condition that the tenant pays arrears, mesne profits, and any other sums the court determines.

Landlords may not forcibly evict; the proper course is to apply to the Rent Magistrate on one of the grounds set out in section 17(1). These include non‑payment of rent, breach of tenancy obligations, nuisance, illegal use, deterioration of the premises, the landlord’s genuine need for personal or family occupation, business purposes, demolition or remodelling, and other specified circumstances.

The law does not provide for an automatic, rent‑free grace period.

"I don't have much yet, but the little I can invest now in land will multiply greatly for your children and their children. This is the best legacy I can give you. The chance to build your own home and secure your family's future," Uncle Kojo said firmly.
