Homebuyer First: Odisha’s Bold Reforms Are Reshaping Real Estate Regulation

Odisha has taken a giant leap in real estate regulation with a powerful set of reforms under its Real Estate Regulatory Authority (ORERA). These changes aim to protect homebuyers, ensure developer accountability, and build a digitally integrated, transparent system for the future.

Odisha is redefining real estate governance with major reforms under ORERA. Here’s what matters:

🔹 Mandatory Buyer Consent
Developers must now get written approval from 2/3rd of allottees before changing plans or common areas.
🔹 Accountability for Planning Authorities
Approvals without buyer consent or on unauthorized land are flagged. Stricter scrutiny is now in place.
🔹 ORERA 2.0 + Tech Integration
Seamless integration with Bhulekh (land records) and SUJOG (citizen services) ensures real-time project verification and fraud reduction.
🔹 Real-Time Reporting & Enforcement
District Collectors and Tehsildars must report illegal construction monthly. BDA & BMC now support enforcement.
🔹 Developer Transparency Mandated
Promoters must:
* Upload occupancy & completion certificates
* Provide quarterly project updates
* Retain 1% of project value for 5 years to cover structural defects

🔹 Clarity on Pre-RERA Projects
The new Apartment Ownership Act, 2023 simplifies resale of older apartments not covered under RERA.
🔹 Institutional Capacity Boost
ORERA will hire staff, including retired officials, and hold regular grievance redressal meetings.
