MHADA Act Amendment Officially Gazetted: Breakthrough for 13,000+ Old Mumbai Buildings!

The legal ambiguity surrounding Section 79A of the MHADA Act is officially resolved! Following the Governor's assent on July 18, 2026, the State Government published Maharashtra Act No. 34 of 2026 in the Official Gazette on July 20, 2026.

This amendment directly removes the technical flaw that led the Bombay High Court to stay nearly 935 Section 79A notices. It removes the legal ambiguity over whether MHADA had the authority to issue C1 notices in the first place.

☑️Key Gazette Highlights:

1⃣"Competent Authority" Defined: Section 2(11)(b) now explicitly designates the Executive Engineer of the concerned division of the Mumbai Building Repairs & Reconstruction Board (MBRRB) as the statutory "Competent Authority" under Section 79A.

2⃣ Terminology Refinements: Section 79A(1) updated terms to distinguish between building "reconstruction" and overall "redevelopment" to streamline legal ex*****on.

🕐How the Revived Section 79A Ex*****on Process Works:

Stage 1 (Landlord): Given 9 months to submit a redevelopment proposal once declared dangerous (C1).

Stage 2 (Tenants): If the landlord defaults, occupants with 51% consent get 6 months to undertake redevelopment.

Stage 3 (MHADA Step-In): If both fail, MHADA can acquire

and redevelop the property directly without requiring further consent.

What Happens Next?

The amendment settles the dispute over MHADA's status as the "competent authority", but it does not end litigation over Section 79A.

MHADA will now need to inform the Supreme Court and get the Bombay High Court's approval, where the matter is pending, before restarting proceedings under Section 79A.

July 22 (Bombay High Court): MHADA will submit the gazetted law to request lifting the stay on ~935 pending notices.

August 20 (Supreme Court): Next hearing on the constitutional validity of Sections 79A & 79B.

Fresh Audits: MHADA is preparing to conduct fresh structural audits to issue new C1 notices.

With over 13,000 Cessed Buildings in the Island City, this amendment paves the way for fast-tracking long-pending urban renewal while prioritizing tenant safety.
