There are many ongoing issues. We have always received mute responses from builder. ARV group is just interested in selling its properties. Once it is sold they do not bother in listening to buyers. It has been almost a year people got possession of there properties in A and B building of the society. Flat owners have tried to reach builder many times to state our reasons of discontent (Listed bel

ow). We have always received a false commitment from builder. After being patient for almost a year now we are preparing a petition stating facts and evidences about ARV Group.

- Society club house is not ready until today. Builder provided commitment to provide club house by end of year 2015.

- Poor quality construction. Water Leakage issues in flats.

- Electricity issues. Whenever it rains the society power goes off for almost 16-18 hours everyday. Whereas all the neighboring societies do not face such issue.

- Society boundary wall is just 4 feet high. Any one can jump inside society from outside roads.

-Huge advertisement posters blocking road view which can cause accidents.

- No provision for dustbins in common society area.

- Unfinished work in society passages on every floor.

- Semi covered parking is not yet provided.

- Improper management of plantation / garden in society premise.

- Improperly fitted tiles inside flats. There are many other issues which I am sure the people will post here inorder to get builders attention and work towards resolution. Builders are amenable under the Consumer Protection Act, 1986
As per a landmark decision passed in 1993 in the case of Lucknow Development Authority vs. M.K.Gupta, the Honourable Supreme Court of India passed a judgement stating that “all builders/contractor(s)/all concerned authorities of any State engaged in Housing Construction activity in any manner are amenable to Consumer Protection Act, 1986 for any act or omission relating to housing activity such as:

“Delay in delivery of possession, non-completion of construction within the stipulated time, defective and faulty construction and more…”
Premium Legal SupportThe judgement states the fact that a builder who constructs a house or hires the services of a contractor to develop a property is engaged in the act of providing service to his customer, and for which he is getting monetarily compensated. This makes him a service provider and hence liable under the clauses of Consumer Protection Act, 1986.
