Leave granted.

1. The Appellant married the Respondent on 02.03.1997 and registered the same under the Special Marriage Act, 1954. Thereafter, the marriage was solemnized between the parties on 07.12.2000 under the Hindu rites and customs. Alleging cruelty and desertion by the Respondent, the appellant filed a suit for dissolution of marriage on 05.03.2007 before the District Judge, Alipore. The suit was dismissed, aggrieved by which the Appellant filed an appeal before the High Court of Calcutta. The Respondent did not appear before the High Court. However, the High Court dismissed the appeal filed by the appellant upholding the judgment of the Trial Court. The allegation made by the Appellant against the Respondent is that she was insisting on his residing separately from his parents. Also, the Respondent misbehaved with her in-laws and that she was frequently leaving the matrimonial home. The appellant also alleged physical assault by the Respondent when both of them went to Puri and Shillong for holidays. The Respondent resisted the Petition filed for dissolution of marriage by denying the averments made against her. She accused the appellant of adultery and excessive consumption of alcohol. The Trial Court and the High Court refused to accept the contentions of the appellant that he is entitled for divorce by holding that he could not make out a case of cruelty meted out by the Respondent.

It was submitted by Mr. Nikhil Nayyar, learned Senior Counsel for the Appellant that the Appellant and Respondent have been living separately for more than 16 years and for all practical purposes the marriage is dead. He relied upon two judgments of this Court in *Sukhendu Das v. Rita Mukherjee, (2017) 9 SCC 632 and Munish Kakkar v. Nidhi Kakkar, (2020) 14 SCC 657* in support of his submission that this Court in exercise of its power under Article 142 of the Constitution of India has dissolved marriages when they are totally unworkable and irretrievable.

3. We have requested Mr. Ranjan Mukherjee to assist this Court as Amicus Curiae on behalf of the Respondent as she did not engage an Advocate. Mr. Ranjan Mukherjee informed this Court that the Respondent intends to continue to live with the Appellant. Mr. Mukherjee informed this Court that he spoke to the Respondent several times and the Respondent is not convinced that an unworkable marriage should be put to an end. In *Sukhendu Das v. Rita Mukherjee (supra),* this Court considered a similar situation where the marriage between the parties took place on 19.06.1992 and they were living apart from the year 2000. The Trial Court found that the husband could not prove cruelty by his wife and that he was not entitled for decree of divorce. The judgment of the Trial Court was upheld by the High Court and the same was the subject matter of challenge before this Court. The Respondent failed to appear before this Court in spite of notice being served. By holding that there was an irretrievable breakdown of marriage, this Court dissolved the marriage between the parties therein by observing that they had been living separately for more than 17 years and no useful purpose would be served by compelling them to live together in matrimony.

4. To do complete justice between the parties, this Court in Munish Kakkar v. Nidhi Kakkar (supra) put an end to the bitter matrimonial dispute which lingered on for two decades between the parties therein.

5. The Appellant is a police officer in the State of West Bengal and has made allegation of cruelty and desertion against the Respondent. Though the respondent has insisted that she intends to live with the Appellant, no meaningful effort has been made by her for reconciliation. Allegations made by the Respondent relate to adultery by the Appellant which was the reason for her moving out of the matrimonial home. In spite of the best efforts made by Mr. Mukherjee, the Respondent has insisted that she is not willing for dissolution of the marriage. Mr. Mukherjee has brought to our notice that the Respondent has to take care of her son who is suffering from serious ailments.

Having scrutinized the material on record and considering the submissions made by Mr. Nikhil Nayyar and Mr. Ranjan Mukherjee, learned Amicus Curiae, without commenting on the merits of the matter, the marriage between the parties is emotionally dead and there is no point in persuading them to live together any more. Therefore, this is a fit case for exercise of jurisdiction under Article 142 of the Constitution of India. The marriage between the parties is dissolved. The Registry is directed to prepare a decree accordingly. Taking note of the submissions made by Mr. Ranjan Mukherjee, we direct the Appellant to pay an amount of Rs.25 Lakhs (Rupees Twenty-Five Lakhs) to the Respondent within a period of eight weeks from today. The petition filed by the Respondent under Section 125 Cr. PC for maintenance shall be withdrawn by the Respondent on receipt of the amount of Rs.25 Lakhs. The payment of the aforesaid amount is in full and final settlement of all claims of the Respondent against the Appellant.

7. The appeal is disposed of accordingly.

📌 *Whether husband can be granted divorce on ground of cruelty if wife is making false complaints against him?*

Cruelty can never be defined with exactitude. What is cruelty will depend upon the facts and circumstances of each case. In the present case, from the facts narrated above, it is apparent that the wife made reckless, defamatory and false accusations against her husband, his family members and colleagues, which would definitely have the effect of lowering his reputation in the eyes of his peers. Mere filing of complaints is not cruelty, if there are justifiable reasons to file the complaints. *Merely because no action is taken on the complaint or after trial the accused is acquitted may not be a ground to treat such accusations of the wife as cruelty within the meaning of the Hindu Marriage Act 1955 (for short ‘the Act’). However, if it is found that the allegations are patently false, then there can be no manner of doubt that the said conduct of a spouse levelling false accusations against the other spouse would be an act of cruelty*. In the present case, all the allegations were found to be false. *The petition for divorce filed by the husband under Section 13 of the Act is decreed and the marriage of the parties solemnized on 13.04.1989 is dissolved by a decree of divorce.*

*We also take judicial notice of the fact that the steep.rise in COVID-19 Virus cases is not limited to Delhi alone but it has engulfed the entire.nation. The extraordinary situation caused by the sudden and second outburst of COVID-19 Virus, thus, requires extraordinary measures to minimize the hardship of litigant–public in all the states. We, therefore, restore the order dated 23rd March 2020 and in continuation of the order dated 8th March, 2021 direct that the period(s) of limitation, as prescribed under any general or special laws in respect of all judicial or quasi-judicial proceedings, whether condonable or not, shall stand extended till further orders. The Delhi high court while hearing a criminal appeal in a r**e case upheld the r**e conviction of the appellant, however, acquitted him for the charge of attempt to murder holding that HIV positive person cannot be liable for an attempt to murder even if sexual in*******se is without the woman’s consent.

The FIR was filed by the appellant’s step-daughter who was allegedly r**ed multiple times by the accused. The prosecutrix made the statement that her step-father forcefully r**ed her multiple times after the demise of her mother when she was 15-years old. Since the accused was HIV positive the prosecutrix was also tested for the disease but her test results came negative. The trial court evaluated all the medical and forensic evidence and statement of the prosecutrix along with other witnesses and convicted the appellant under section 376,313 and 307 of the IPC for r**e, miscarriage, and attempt to murder of the prosecutrix and sentenced him to 25 years imprisonment.

The appellant aggrieved by the trial court’s judgment the accused filed an appeal in the Delhi high court. The counsel for the appellant contended that the prosecutrix has changed her statement under oath due to which her testimony is unreliable and also defended the accused on other charges pleading that the accused be acquitted of all charges.

The single-judge bench of Delhi high court of Justice Vibhu Bakhru upheld the trial court’s conviction under section 376 IPC for r**e after finding that there was enough forensic and medical evidence that corroborated the prosecutrix testimony. However, the court found no sufficient material on record to charge the appellant under section 313IPC for miscarriage and acquitted the appellant for the same.

On the issue of the trial court’s conviction under section 307IPC for an attempt to murder the court held a different view and dictated that such an instance of r**e by an HIV positive patient cannot be seen as an attempt to murder. The court remarked “This Court is unable to subscribe to the aforesaid approach of the learned Trial Court. Merely because the learned Judge was of the view that the Legislature must provide for a higher punishment for non-disclosure of the STI/STD status of the person engaging in sexual activity, does not justify contriving to classify it as an offense entailing a higher punishment.” Regarding the legal implications of the trial court’s judgment the high court held that the learned trial court judge erred in charging the accused with an attempt to murder and commented “that the import of holding so would also mean that any sexual activity by a person infected by HIV is punishable under Section 307 of the IPC, notwithstanding that his or her partner has consented to such sexual activity. This is because the culpable act under Section 307 of the IPC does not cease to be one if the victim of such an act has also consented to the same. If the reasoning adopted by the learned Trial Court is extended further, it would also mean that a healthy person who willingly engages in unprotected sexual in*******se with an HIV positive partner and acquires the said disease as a result thereof that eventually proves fatal, would have committed su***de and, the HIV positive partner would be guilty of abetment of su***de under Section 306 of the IPC if not guilty of committing murder as defined under Section 300 of the IPC.”

The court relied on laws of multiple other countries regarding the spread of such disease and held that it might be an aggravating factor while sentencing but there are no specific laws regarding it. The court was of the opinion that the conduct of the accused may not come under the purview of an attempt to murder since there was no intention of killing and the same was also not contended by the prosecution. The court criticizing the trial court’s view on the matter remarked “The Trial Court has proceeded on the basis that the act of penetrative sexual in*******se by a person who is HIV positive is likely to cause death to the receptive partner. This is based on two assumptions. First, that such sexual in*******se is most likely to transmit the disease to the healthy partner; and second, that on the transmission of the disease, the partner so infected is likely to die. However, both the said assumptions, are without basis and without any scientific evidence, to support the same.” Since there was no disease transmitted to the victim and there was no mal-intent to kill the victim, the court scrapped the charges under section 307 IPC. The court also mentioned that section 270 IPC( malignant act to spread disease dangerous to life) was not applicable in the present case since there was no malice on the part of the accused regarding the spreading of the disease. The court, therefore, only upheld the conviction for r**e under section 376 of IPC and set aside conviction and sentencing under section 313 and 307 of IPC, and disposed of the appeal.
